Sought support in House Transportation and Infrastructure Committee for HR 4278. Detailed explanation attached. Section 404(f)(1) exempts activities such as farming, farm ponds, irrigation ditches and farm roads from Section 404 permitting requirements, however, the Environmental Protection Agency (EPA) and the Army Corps of Engineers often interpret the Section 404(f)(1) exemptions in such a way that they are almost entirely negated by the recapture provision in Section 404(f)(2). H.R. 4278 would clarify Congress original intent reiterating that Section 404(f)(1) already says that normal farming and ranching activities are exempt from federal regulation under the CWA and would not allow EPA and the Corps to take away or narrow those exemptions for planting, constructing or maintaining a farm pond, constructing or maintaining irrigation or drainage ditches, or constructing or maintaining farm roads. Actively engaged association and grassroots in working to prevent EPA from enacting Guidance Document that would effectively remove the word navigable from the Clean Water Act and allow EPA jurisdiction over most waters in Oregon.

Opposition to S. 1610 and H.R. 2681, the Cement Sector Regulatory Relief Act, which would weaken and delay clean air standards for cement plants. Support for EPA-Army Corps of Engineers guidance and rule-making to clarify the jurisdiction of the Clean Water Act, which would help protect wetlands and marginal streams that flow into sources of drinking water for millions of Americans. Opposition to H.R. 872, the Reducing Regulatory Burdens Act of 2011, which would amend the Federal Insecticide, Fungicide, and Rodenticide Act and the Federal Water Pollution Control Act to clarify Congressional intent regarding the regulation of the use of pesticides in or near navigable waters, and for other purposes. Support for the EPA to issue strong rules under the Clean Air Act regulating air pollution from cement kilns, industrial boilers, and utilities to in order to protect public health and the environment. Support for the EPA to move forward with strong rules under the Clean Air Act to reduce greenhouse gas emissions. Opposition to S. 1833, the Fair Compliance Act of 2011 which would block the EPAs ability to clean-up life-threatening pollution from power plants. Support for a strong final soot standard issued by the EPA this year. Support for banning diesel as part of EPAs draft guidance on the use of diesel in hydraulic fracturing. Opposition to H.R. 3409, the Stop the War on Coal Act of 2012, which guts bedrock protections in the Clean Water Act, Clean Air Act, Resource Conservation and Recovery Act, and Surface Mining Control and Reclamation Act, all of which Americans have relied on for decades to protect them from uncontrolled pollution. Opposition to potential EPA approval of the state of Floridas proposed water quality standards that fail to protect its waters from toxic algae outbreaks. Opposition to Shells request to negotiate a compliance order to violate air pollution standards it already agreed to meet as part of its Arctic Ocean offshore drilling program. Opposition to H.R. 4278, the Preserving Rural Resources Act of 2012, which would increase water pollution by dramatically expanding exemptions in current law for activities that discharge dredged or fill material. Opposition to H.R. 5961, the Farmer's Privacy Act of 2012, which is a radical restriction on the ability of the Environmental Protection Agency and state pollution control officials to identify violations of the Clean Water Act by industrial livestock facilities. Opposition to H.R. 2541, the Silviculture Regulatory Consistency Act, which exempts any logging operation that generates runoff from the requirement to obtain pollution-limiting permits for any discharge resulting from various logging-related activities. Opposition to H.R. 3158, the Farmers Undertake Environmental Land Stewardship Act, which would treat farms that store oil or oil products differently than other similar operations for purposes of the Clean Water Acts spill prevention, control, and countermeasure requirements. Opposition to S. 3558, the Clean Water Cooperative Federalism Act, which is a blatant assault on the Clean Water Act that undermines the legacy of coordination and balance between federal and state governments that has resulted in significant progress towards cleaning up our nations waters. Opposition to EPA proposal to delay the implementation of the life-saving toxics standards for cement kilns .

"Preserve the Waters of the U.S. Act" (S. 2245): Legislation that would prohibit the Secretary of the Army and Administrator of the Environmental Protection Agency from finalizing the proposed guidance entitled "EPA and Army Corps of Engineers Guidance Regarding Identification of Waters Protected by the Clean Water Act" (EPA-HQ-OW-2011-0409). The organization opposes an expansion of the Clean Water Act, which would be the result of the agency guidance. (Continued). "Farm Dust Regulation Prevention Act of 2011" (H.R. 1633/S. 1528): Legislation that would temporarily prevent the EPA from changing the national ambient air quality standard (NAAQS) for course particulate matter for one year. The bill would also exempt "nuisance dust" from regulation, unless nuisance dust was found to cause serious adverse health effects, and the benefits of regulation exceeded the costs. The organization supports H.R. 1633 and S. 1528. Chesapeake Bay Program Reauthorization and Improvement Act (H.R. 4153): A bill that would modify the existing Chesapeake Bay Program under the Clean Water Act. It would ensure states rights are protected with regard to decision-making about clean water plans, prompt a review of the Environmental Protection Agencys (EPA) watershed model, and create an independent evaluation commission to oversee the scientific validity of EPAs model. The organization supports the bill. Preserving Rural Resources Act of 2012 (H.R. 4278): Legislation that would amend the Clean Water Act regarding permit requirements for dredged or fill material. The organization supports the bill because its purpose is to preserve the agricultural exemptions granted to farmers and ranchers by Congress in Section 404(f) of the Clean Water Act.
