Consumer and Fuel Retailer Choice Act This bill amends the Clean Air Act to address the limitations on Reid vapor pressure (a measure of gasoline's volatility) that are placed on gasoline during the summer ozone season. The bill applies the Reid vapor pressure requirements that are applicable to gasoline blended with 10% ethanol (E10) to gasoline blended with more than 10% ethanol. Thus, the waiver given to E10 gasoline, which allows an increase in the Reid Vapor Pressure volatility, is extended to gasoline blended with more than 10% ethanol.

H.R.777 by U.S. Rep. James F. Sensenbrenner provides for a comprehensive assessment of the scientific and technical research on the implications of the use of mid-level ethanol blends, and for other purposes. HR 1315, RFS Reform Act of 2017, by U.S. Rep. Robert Goodlatte to amend the clean air act to eliminate requirements under the renewable fuel program, to prohibit the Administrator of the EPA from approving the introduction into commerce gasoline that contains greater than 10% volume percent ethanol. HR 1315 (RFS Reform Act of 2017): 55 cosponsors, AMA raised concerns with the EPA regarding an E15 Misfueling Mitigation Plan, 2018 Renewable Volume Obligation and Reid Vapor Pressure. HR 5855 Scott Austin (R-GA8)-Requres the Administrator of the Environmental Protection Agency to revise labeling requirements for fuel pumps that dispense E15 and for other purposes. HR 5212 Sponsored by U.S. Rep. Peter Welch (D-VT) and S 2519 Sponsored by Tom Udall (D-NM) are companion bills called the "Growing Renewable Energy through Existing and New Environmentally Responsible Fuels Act (The GREENER Fuels Act). They amend the Clean Air Act to reform the renewable fuel program under that Act, and for other purposes. It caps the nation's fuel supply at 9.7% ethanol requiring the EPA to prioritize the use of cellulosic biofuel ahead of other biofuels when determining volumes below the blend wall levels. Consumer and Fuel Retailer Choice Act is sponsored by U.S. Rep. Adrian Smith (HR 1311) and by U.S. Senator Deb Fischer (S 517). The bill would extend the Reid vapor pressure (RVP) waiver to ethanol blends above 10 percent. This would increase market access opportunities for higher blends of ethanol. It would allow retailers across the country to sell E15 and other higher-ethanol/gasoline fuel blends year-round.

US H.R.350 RPM Act of 2017 introduced by U.S. Rep. Patrick McHenry that clarifies congressional intent to exempt racing vehicle from the Clean Air Act. US Sen. 203 by U.S. Sen. Richard Burr that reaffirms that the EPA may not regulate vehicles used solely for competition, and other purposes. This is a companion bill for H.R. 350. HB 5212 (U.S. Rep. Peter Welch and S2519 (U.S. Sen. Tom Udall) are companion bills referred to as the Greener Act (Growing Renewable Energy Through Existing and New Environmentally Responsible Fuels Act). They cap mandated ethanol content in the Nation's fuel supply at 9.7% and require the prioritization of cellulosic biofuel. In addition, they maintain a continuing place in the market for ethanol-free gas. HR 350 (U.S. Rep. Patrick McHenry and S 203 (U.S. Sen. Richard Burr) are companion bills referred toas the RPM Act of 2017. They clarify congressional intent to exempt racing vehicles from the Clean Air Act. S517 is the Consumer and Fuel Retailer Choice Act that amends the Clean Air Act with respect to the ethanol waiver for Reid Vapor Pressure limitations to allow the sale of E15 during the summer months. HR 1311-This bill amends the Clean Air Act to address the limitations on Reid vapor pressure (a measure of gasoline's volatility) that are placed on gasoline during the summer ozone season. S 3604 To require a study to determine the best available estimate of the total amount of nonhighway recreational fuel taxes received by the Secretary of the Treasury. Ms. Klobuchar (for herself, Mr. Risch, Mrs. Shaheen, and Mr. Burr) introduced the following bill; which was read twice and referred to the Committee on Environment and Public Works.

H.R. 1311 - Consumer and Fuel Retailer Choice Act and S. 517 - Consumer and Fuel Retailer Choice Act - Seeking support for a waiver on RVP on retail ethanol blends above 10% (i.e. E15 and above). Current EPA regulations prevent the sale of higher blends, such as E15, to be sold during the summer months. The regulation is not appropriate for higher blends of ethanol blended gasoline as higher blends such as E15 were not commercially available at the time when RVP waivers were written for other blends.

Discussions encouraging legislation granting a 1lb. Reid Vapor Pressure (RVP) waiver to ethanol-blended fuel above 10% within the RFS - H.R. 1311 - Consumer and Fuel Retailer Choice Act & S.517 - Consumer and Fuel Retailer Choice Act. Strongly discouraging any caps that may be placed on Renewable Identification Numbers (RINs) as a part of the Renewable Fuels Standard. Furthermore, we fully support the President's recent announcement and action of the US EPA in moving forward with implementing regulation to provide RVP parity for fuel ethanol blends up to E15 by the June 1, 2019 summer fuel blend deadline.

KFB continues to discuss the consequences of the the Water of the United States (WOTUS) rule and lobby for it to be fully repealed by Congress. KFB supports Acting EPA Administrator Wheeler's efforts to roll out a new Clean Water, Clear Rule to replace the previous WOTUS regulations. KFB supports S. 517 and HR 1311, which gives ethanol a fair opportunity to be sold throughout the year. Retailers should be able to choose what products they sell at the fuel pump. KFB also is not in favor of the ethanol point of obligation to be changed. KFB has lobbied the Kansas congressional delegation and Administrator Wheeler to engage in conversations taking place at the White House regarding ethanol, specifically supporting E15 to be sold all year long, and we look forward to the update rule being released so that E15 may be sold starting in the summer of 2019. KFB continues to support sound science and the ability for farmers to utilize the latest herbicide technology on their 2018 crops. We lobbied for dicamba to be re-registered and approved in 2019 crop seasons and beyond. KFB discussed the importance of annual prescribed wildfires to maintain and preserve the native ecosystem of the Flint Hills (tallgrass) prairie system with EPA.
