Leave Ethanol Volumes at Existing Levels Act or the LEVEL Act This bill revises the renewable fuel program, including the renewable fuel standard (RFS). Under current law, the RFS specifies the minimum volume of renewable fuel, such as ethanol, that must be contained in gasoline sold in the United States. The RFS annually increases until 2022 when a minimum of 36 billion gallons of renewable fuel must be blended into gasoline. The bill decreases the volume of renewable fuel that must be contained in gasoline to 7.5 billion gallons each year. The bill also revises the RFS to eliminate separate volume requirements for the following renewable fuel categories: advanced biofuels, cellulosic biofuel, and biomass-based diesel. In addition, the bill revises requirements concerning waivers from the program. Petitions for waivers from requirements under the renewable fuel program may not be brought by a person who is subject to the requirements of the program, nor by the EPA on its own motion. The EPA may not authorize the sale of gasoline that contains greater than 10% ethanol, unless the gasoline was registered under the program and lawfully sold in the United States before this bill's enactment. The EPA must study the effects of gasoline that contains greater than 10% ethanol, including the effects on consumer products, such as nonroad vehicles.

Testified at a virtual public hearing on the Proposed Extension of Renewable Fuel Standard (RFS) Compliance Deadlines the Environmental Protection Agency (EPA) proposed in November. The testimony pointed out that if EPA would have finalized the 2021 Renewable Volume Obligations (RVOs) on time the previous November and predicted gas volumes would return to 2019 levels, the 2021 percentage would have assured refiners their renewable fuel requirements would again fall or rise as petroleum volumes remained flat or grew. Thanked U.S. Department of Energy Argonne National Laboratory (ANL) scientists for updates to the Greenhouse gas and Regulated Emissions and Energy use in Transportation (GREET) model, which is widely recognized as the gold-standard tool used to audit the energy and environmental effects of transportation fuels such as ethanol and gasoline.

Thanked a group of House and Senate members for urging for support for renewable fuels in the reconciliation package by specifically requesting leadership consider bipartisan proposals that have been introduced this year to provide incentives for retailers to sell E15 and E85 and for automakers to resume the production of flexible fuel vehicles, to encourage the use of higher blends of ethanol, and to ensure E15 can be available year-round. Sent a letter to House Committee on Energy and Commerce Chairman Frank Pallone, Jr. following Congresswoman Cheri Bustos' introduction of the Next Generation Fuels Act of 2021 (H.R. 5089), requesting a legislative hearing on the bill in order to receive testimony on how it would help remove market barriers to ethanol and improvements that should be made to the legislation to reward farmers for climate-smart practices and ethanol producers for investments to reduce the carbon intensity of their fuel. Sent a letter to President Biden asking him to set the maximum statutory volumes under the Renewable Fuel Standard in the 2021 and 2022 Renewable Volume Obligation rulemaking and pursue all options to ensure uninterrupted market access for E15. Opposed the U.S. Environmental Protection Agencys (EPA) motion to remand but not vacate the 31 small refinery exemptions (SREs) the Trump Administration granted in August 2019.

Supported S. 2262/H.R. 4254, bills to establish an income tax credit for the sale or blending of certain fuels containing ethanol. Submitted comments on the proposed rule E15 Fuel Dispenser Labeling and Compatibility With Underground Storage Tanks that the Environmental Protection Agency (EPA) announced in the final days of the Trump administration. The rule co-proposes EPA either modify the E15 label or remove the label requirement entirely. Further, EPA proposes to modify the underground storage tank (UST) regulations which offer paths that would make it easier for station owners to demonstrate compatibility with E15 and possibly higher ethanol blends in the future. EPAs proposed changes to compatibility rules would make it easier for station owners and operators to store and sell E15 using existing equipment, and changes to E15 label requirements could reduce consumer confusion and resistance to trying E15. Sent letters to House and Senate leaders and key committee chairs, urging them to take a technology-neutral approach when making investments to accelerate the nations transition to clean energy in the transportation sector and provides recommendations for ways Congress can spend a fraction of funds being discussed in support of the electric vehicle (EV) supply chain by capitalizing on ethanols ability to make near-and-long-term reductions in greenhouse gas (GHG) emissions.

Supported S. 193, the Adopt GREET Act, which would require EPA to update its outdated lifecycle modeling for ethanol and biodiesel, specifically by adopting the latest Argonne National Labs Greenhouse Gas and Regulated Emissions and Energy Use in Transportation (GREET) Model. Supported H.R. 1113, the Renewable Fuel Standard Integrity Act, legislation that addresses the timing and transparency issues associated with the small refinery exemption (SRE) program under the Renewable Fuel Standard (RFS). Opposed H.R. 190, the Leave Ethanol Volumes at Existing Levels (LEVEL) Act, legislation to repeal the Renewable Fuels Standard II (RFS), leaving RFS I levels intact. Submitted comments to EPA's request for comments on petitions received for a waiver for refiners from their blending obligations under the 2019 and 2020 Renewable Fuel Standard (RFS), urging EPA to reject the waiver requests. Sent a letter to the EPA Inspector General encouraging he ensure that all communications from EPA Administrator Andrew Wheeler and any correspondence of President Trumps political appointees about pending SRE petitions be preserved, in part, to ensure that dispensation of Small Refinery Exemption (SREs) waivers comply with federal laws regarding political appointees roles in federal acts affecting a personal financial interest. Praised EPA's approval of the removal of the low Reid Vapor Pressure (RVP) gasoline requirements in the Kansas City metro area, which now allows for E15 fuel to be sold in the area year-round.
