Proposal would create safe harbors for fiduciaries who select the investment options offered in 401(k) plans. If a fiduciary considers six factors when selecting any investment option, including alternative assets such as private equity, private credit, real estate, or cryptocurrency to a plan menu, the proposal would treat the fiduciary as meeting ERISAs prudence standard with respect to those factors, which would entitle the fiduciary to deference from any reviewing court. A bill that would undermine ERISAs ability to protect retirement plan participants hard-earned retirement income under the erroneous notion that the recent unanimous Supreme Court decision in Cunningham v. Social Security Administration. Removing Barriers to Work for Disabled Americans Act (H.R. 8884/S. 4947).
