Sensible Environmental Protection Act of 2017 This bill amends the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to prohibit the Environmental Protection Agency or a state from requiring a permit under the National Pollutant Discharge Elimination System (NPDES) for a discharge of a pesticide from a point source into navigable waters if the discharge is approved under FIFRA. Point source pollution is waste discharged from a distinct place, such as a pipe, channel, or tunnel. The bill establishes exemptions from this prohibition.

1. S. 340, the "Sensible Environmental Protection Act of 2017" H.R. 953, the "Reducing Regulatory Burdens Act of 2017" This legislation would eliminate the Clean Water Act's NPDES pesticide general permit for aquatic pesticide applications in, over, or near "Waters of the United States". Such applications are already regulated under the Federal Insecticide, Fungicide, and Rodenticide Act. 2. HR 1029, the "Pesticide Registration Improvement Extension Act of 2017" This legislation reauthorizes PRIA, the Pesticide Registration Improvement Act, which supports the registering new pesticides and pesticide products and review of existing pesticide products. 3. Administrative efforts to withdraw and replace the "Clean Water Rule", also known as the "Waters of the U.S. Rule". This rule would expand the scope of the Clean Water Act's jurisdiction. 4. Efforts to secure funding in the Farm Bill and FY 19 Appropriations for turfgrass research. 5. Reform of the Endangered Species Act. 6. Regulatory uniformity regarding the sale and use of pesticides within states.

TFB supports the S. 2421, the FARM Act in the Senate and H.R. 5275, the ACRE Act in the House to provide relief from new reporting rules in the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). The House and Senate legislation would return us to the 2008 CERCLA reporting requirements essentially exempting ag/livestock producers from reporting. TFB supported H.R. 5, the Regulatory Accountability Act to solve the problem of overreaching, ill-considered government regulations that negatively impact farmers and ranchers. TFB advocated for the legislation which requires agencies to choose the lowest-cost rulemaking alternative that meets statutory objectives and requires greater opportunity for public input and vetting of critical information for rules passed by agencies. TFB supported an amendment by Rep. Collin Peterson to prohibit agencies from impartially communicating with the public in order to generate support or opposition to a proposed rule. TFB supports the passage and enactment of H.R. 953, the Reducing Regulatory Burdens Act, and S. 340, the Sensible Environmental Protection Act (SEPA) which would clarify Congressional intent regarding regulation of the use of pesticides in or near navigable waters. TFB corresponded with Members of Congress to express support for reducing duplicative and needless regulations on pesticide applicators used by agricultural producers.
