Over-the-Counter Hearing Aid Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act to require the Food and Drug Administration (FDA) to categorize certain hearing aids as over-the-counter hearing aids and issue regulations regarding those hearing aids. The regulations for over-the-counter hearing aids must: (1) provide reasonable assurances of safety and efficacy; (2) establish output limits and labeling requirements; and (3) describe requirements for the sale of hearing aids in-person, by mail, or online, without a prescription. State and local governments may not establish or continue in effect requirements specifically applicable to hearing products that are not identical to FDA requirements and that restrict or interfere with the servicing or sale of over-the-counter hearing aids. The FDA must update and finalize its draft guidance on hearing products. The guidance must clarify which products are medical devices.

Supported H.R. 2550, the Medicare Telehealth Parity Act which would allow audiologists to be reimbursed by Medicare for services administered via telehealth. The Academy has met with congressional offices on the Access to Frontline Health Care Act (H.R. 2042). This legislation would allow for medical practitioners in certain fields to have some of their student loans covered by the Department of Health and Human Services in exchange for practicing for two years in federally-defined frontline shortage areas. AAA met with Congressional offices to learn about the possible viability of legislation that would expand Medicare to cover hearing aids and related services to hearing aids in the 116th Congress. AAA has engaged in efforts to educate legislators about the recommendations relative to implementation of the Over-the-Counter Hearing Aid Act (S.670, H.R. 1652), as put forth in a white paper co-authored by organizations representing audiologists and hearing aid dispensers. AAA also met with the Food and Drug Administration regarding recommendations related to labeling and specifications of the forthcoming over-the-counter hearing aids.

Supported the Early Hearing Detection and Intervention Act (H.R. 1539, S. 562), a bill that proposes to amend the Public Health Service Act to reauthorize a program for early detection, diagnosis, and treatment regarding deaf and hard-of-hearing newborns, infants, and young children. Met with the FDA to discuss the potential regulations that would be promulgated from the Over-the-Counter Hearing Aid Act (S. 670, H.R. 1652) and the Medical Device User Fee Amendments (S. 934, H.R. 2430). This legislation authorized the FDA to create a category of hearing aids available over the counter for individuals who perceive that they have mild-to-moderate hearing loss.
