Support Policies that Address the Systemic IT and Engineering Professional Talent Shortage in the U.S. While Continuing to Meet Near-Term Needs The U.S. has for many years suffered from a shortage of highly-skilled technical professionals. A qualified workforce is essential to the U.S. economy and the success of the IT and engineering staffing industry. TechServe Alliance supports policies that address the systemic talent shortage including increasing resources for STEM education and worker training. Further, to meet near-term needs, Congress should provide access to a reasonable number of IT & engineering professionals on H-1B visas without any policy changes that discriminate against U.S.-based IT and engineering staffing firms.

Clarify the FLSA Definition of Computer Professional to Reflect Hundreds of New IT Occupations The 1990s definition of computer professional, as codified in the Fair Labor Standards Act (FLSA), was enacted when the World Wide Web and the Internet were in the infancy stage. As America's technology industry has grown at an extremely fast pace for more than two decades, there are literally hundreds of new IT professional occupations. TechServe Alliance strongly supports efforts to resolve any doubt about whether these new IT occupations fall within the FLSA computer professional exemption through updating and clarification of the statutory language

IT and Engineering Consultants Should Be Able to Choose to Provide their Services as Independent Contractors Tax and employment laws and regulations should fully accommodate IT and engineering staffing consultants who choose to offer their services as independent contractors. TechServe Alliance Files comments on 20% Pass-Through Deduction Proposed Regulations TechServe believes the proposed rule made clear that member firms that operate as sole proprietorships, limited liability corporations, partnerships, or S corporations would be eligible for the full 20% pass-through deduction.

IT and Engineering Consultants Providing Services as Independent Contractors Should Be Treated the Same as Professionals in Other Industries Some IT and engineering professionals choose to operate their own businesses by providing services as independent contractors. Recent tax reform efforts have proposed revising the safe harbor for employers. However, certain provisions in past proposals would have made it difficult if not impossible for the IT and engineering staffing firms to be eligible for the new safe harbor. Given that the 115th Congress may enact major tax reform, we ask that future legislative efforts include a revised safe harbor provision for independent contractor status that fully accommodates independent professionals working within the IT and engineering staffing and solutions industry.

1. Clarification of the Computer Professional Exemption As America's technology industry has grown at an extremely fast pace in the last decade, there are literally hundreds of new IT professional occupations including a substantial increase in Internet and World Wide Web occupations. As a result, it is important to resolve any doubt about whether these occupations come within the "computer professional" exemption under the Fair Labor Standards Act (FLSA). Consequently, TechServe Alliance strongly supports the effort to clarify the "computer professional" exemption. 2. Unduly Burdensome Regulations and Government Mandates Should Not Be Imposed on U.S. IT & Engineering Staffing and Solutions Companies As U.S. IT & engineering staffing and solutions firms deliver services to their clients, they create a significant number of highly-skilled highly-paid jobs in the United States. While welcoming the opportunity to compete on a level playing field, we urge lawmakers to refrain from imposing unduly burdensome regulations and government mandates that would place the industry at a competitive disadvantage and put U.S. jobs at risk. In that vein, TechServe Alliance opposes any effort to restrict the right of IT and engineering professionals to provide their services in any lawful manner, including as independent contractors. Further, while we support market-based solutions to issues such as escalating health insurance cots, we oppose government mandates that would materially increase the cost of firms doing business in the United States

Increased Educational and Training Opportunities in IT & Engineering for U.S. Workers As has been well documented, long-term, the U.S. faces a shortage of highly skilled technical professionals. TechServe Alliance supports public policy initiatives that seek to increase the availability and attractiveness of education and training for U.S. workers in high-tech fields. In addition to the importance of these efforts to the U.S. economy as a whole, a qualified workforce, which is able to meet current and future IT and engineering needs, is critical to the continued success of the IT & engineering staffing and solutions industry.
