Disability Access to Transportation Act This bill expands transportation access for individuals with disabilities. Specifically, the bill requires the Department of Transportation to establish a one-stop paratransit pilot program to develop or expand paratransit programs carried out pursuant to the Americans with Disabilities Act of 1990 (ADA) to prevent long wait times between multiple trips that unduly limit an individual's ability to complete essential tasks; issue regulations enforcing guidelines that set forth minimum standards for pedestrian facilities in the public right-of-way; implement procedures that allow an individual to submit an ADA complaint by phone, by mail-in form, and online; require each public transit provider and contractor providing paratransit services to post certain information for how an individual can file a disability-related complaint; file yearly reports of accessibility complaints; and create an accessibility data pilot program to assist states and metropolitan or rural planning organizations to improve their transportation planning.

United Spinal continued discussions around key provisions of H.R. 6248, the Disability Access to Transportation Act (DATA) bill, that were successfully included in the Democratic version of the surface transportation bill, H. R. 2, INVEST in America or Moving Forward Act, that has passed the House. And continues to focus efforts on including similar provisions in the Senate Republican led version S. 2302, Americas Transportation Infrastructure Act of 2019. United Spinal supported a letter from the cochairs of the CCD Transportation Task force for the National Highway Transportation and Safety Administration on Federal motor vehicle safety standards and minimal sound requirements for hybrid and electric vehicles - stating disappointment that manufacturers have been unable to implement FMVSS 141. United Spinal submitted comments to the U.S. Department of Transportation's national online dialogue, Feedback on the Accessibility Strategic Plan Framework, to identify best ways to ensure that America's transportation system is accessible to all travelers. Discussed autonomous vehicle priorities with the U.S. Access Board. U.S. Access Board reached out to us to discuss.

United Spinal endorsed comments from the Consortium of Citizens with Disabilities Transportation Task Force to the Department of Transportation on the agencys Design Challenge Initiative, highlighting recommendations in accessible design. United Spinal also sent in its own comments. United Spinal, as a member of the Consortium for Citizens with Disabilities (CCD) Transportation Task Force, supported a letter to the U.S. House and U.S. Senate submitted by the Task Forces Co-Chairs urging increased funding for Department of Transportation (DOT) programs impacting people with disabilities in the FY 2021 Transportation, Housing and Urban Development, and Related Agencies (T-HUD) appropriations bill. United Spinal, as a member of the Consortium for Citizens with Disabilities (CCD) Transportation Task, supported a Task Force Co-Chairs letter to House leadership to urge amending mask and protective face covering requirements for all passengers in transit, Amtrak and air travel in in the HEROES Act, and to take into consideration the needs of people with disabilities. United Spinal supports the Disability Access to Transportation Act, H.R 6248. U.S. Department of Transportation - Autonomous Vehicles United Spinal signed onto a letter sent to the Department of Transportation offering comments on the National Highway Traffic Safety Administrations proposed rulemaking on Occupant Protection for Automated Driving Systems. This proposed rulemaking seeks to update safety standards to take into account the inherent differences between typical road-worthy vehicles and autonomous vehicles. The letter offers several suggestions for incorporating the needs of people with disabilities. Comments Concerning Occupant Protection for Automated Driving Systems Docket Number: NHTSA-2020-0014 United Spinal, along with numerous disability organizations, as members of the Consortium for Citizens with Disabilities (CCD) Transportation Task submitted comments in response to the National Highway Traffic Safety Administration (NHTSA) request for comments regarding Occupant Protection for Automated Driving Systems (ADSs). The letter read in part: The promise and safety of ADS-equipped vehicles will only be realized if vehicles equipped with ADS and without steering wheels are fully accessible, the Americans with Disabilities Act upheld, and safety elements take into account the needs of people with disabilities. We view this time of innovation and reimaging as an opportunity to not only maintain the current level of protection and performance offered by the 200 Series Federal Motor Vehicle Safety Standards (FMVSS), but also to improve the levels of safety and accessibility that they afford. Surface Transportation Legislative Proposals and PrioritiesUnited Spinal, along with numerous disability organizations, as members of the Consortium for Citizens with Disabilities (CCD) Transportation Task developed Surface Transportation Legislative Proposals and Priorities. Transportation is necessary for 57 million people with disabilities in the U.S. to contribute to and participate in their communities, support and spend time with family and friends, and live their lives to the fullest; however, significant barriers to accessible, equitable, reliable transportation remain across modes. Priorities cited include: Assess and increase the availability of fully-accessible, integrated transit and on-demand mobility services. Assess and address continued discrimination in transit and on-demand mobility services through partnerships and public accommodation and other issues.

United Spinal continues dialogue with Congressional offices and with members of other disability advocacy organizations as we work together to agree on legislative language that would both advance accessibility in transportation and protect the hard-won gains of the ADA. United Spinal responded to the Congressional request for continued feedback on the bicameral, bipartisan self-driving car legislation. United Spinal noted that automakers need to include information on their accessibility features as part of their consumer education; include accessibility and universal design expertise in their personnel and staffing hiring; include a process for taking preventative and corrective actions to mitigate against vulnerabilities, including cybersecurity incident response plans which must address accessibility; and, we must make certain that the Model Minimum Uniform Crash Criteria address disability and accessibility matters. United Spinal also supported similar comments to Congress, drafted by the Consortium for Citizens with Disabilities Transportation Task Force. United Spinal has provided input to the U.S. Access Board on: A Study Initiated on Equipping Passenger Aircraft with Wheelchair Restraint Systems on January 13, 2020. The Access Board is undertaking a study that has the potential to advance access to air travel for passengers who use wheelchairs. As directed by Congress, this project will assess the feasibility of equipping passenger planes with restraint systems so that passengers can remain in their wheelchairs on flights. Having to transfer out of wheelchairs makes air travel very difficult, if not impossible, for many people with disabilities. Accessible Lavatories on Single-Aisle Aircraft Consortium for Citizens with Disabilities (CCD) Transportation Task Force United Spinal, as a member of the Consortium for Citizens with Disabilities (CCD) Transportation Task Force, supported a letter in response to a rulemaking on Accessible Lavatories on Single-Aisle Aircraft; Part 1. While the ability to access an aircraft lavatory inflight is an opportunity most air travelers take for granted, people with disabilities often face barriers to the use of the aircraft lavatory that requires changes to their ability and willingness to fly. The Department of Transportation must support further defining accessible with respect to call buttons and door locks. Transportation Access and Safety for People with Disabilities During and After COVID-19 As a member of the Consortium for Citizens with Disabilities (CCD) Transportation Task Force along with numerous other disability organizations, United Spinal signed on to a letter to urge US Department of Transportation Secretary Chao to ensure that transportation service responses to COVID-19 do not discriminate based on disability, that service is maintained in line with public health and social distancing standards, and the needs of workers and passengers with disabilities are met. Transportation for America United Spinal, along with numerous other organizations, signed on to a letter to Congress requesting additional funding to ensure access to public transportation during the COVID-19 pandemic. Rep. Jim Langevin (D-RI) introduced the Disability Access to Transportation Act (H.R. 6248) on March 12, 2020, along with Representatives Dina Titus (D-NV-1) and John Katko (R-NY-24). This bill is the result of months of discussions initiated by United Spinal staff with Rep. Langevins staff about the disability communitys transportation accessibility needs and what improvements can be included in the next 5-year surface transportation bill that is due to be considered this year. Provisions include a paratransit pilot program to allow for one stop during a paratransit trip; finalizing public rights of way, Proposed Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way from July 2011; an improved accessibility complaints process and an accessibility data collection system on transportation modes. United Spinal signed onto a press release, spearheaded by American Association for Justice along with Disability Rights Education and Defense Fund, Access Living and others highlighting the need to remove forced arbitration from litigation options which can negatively impact the rights of people with disabilities and others if there are any accessibility standards violated. AAJ and others met with Congress on this issue.
