(This measure has not been amended since it was introduced. The summary has been expanded because action occurred on the measure.) Energy Savings Through Public-Private Partnerships Act of 2017 (Sec. 2) This bill amends the National Energy Conservation Policy Act to revise requirements for energy savings performance contracts and utility energy service contracts (performance contracts). These contracts allow federal agencies to work with private contractors on energy efficiency upgrades to federal facilities, unless the facilities are dams, reservoirs, or hydropower facilities owned or operated by federal agencies. Current law requires federal facility energy managers to evaluate and identify energy and water efficiency measures for federal facilities, but agencies are not required to implement the measures. The bill requires agencies to implement the measures if they are cost-effective. The Department of Energy must report to the President and Congress on each agency's performance contracts, including their investment value and their energy savings. The energy conservation measures that may be contained in performance contracts are expanded by including those involving energy consuming devices and required support structures. Agencies may not limit recognition of operation and maintenance savings associated with energy systems that were modernized or replaced with energy conservation measures and water conservation measures (e.g., lower energy and water bills due to energy efficiency and conservation measures). Agencies may sell or transfer energy savings and apply the proceeds to fund a performance contract. The energy savings that may be contained in performance contracts are expanded to include: (1) the use, sale, or transfer of energy incentives, rebates, or credits (including renewable energy credits) from governments or utilities; and (2) any revenue generated from a reduction in energy or water use, more efficient waste recycling, or additional energy generated from more efficient equipment.

Advocacy in support of BCSE FY 2019 funding priorities: Energy and Water programs in the Y 2019 Energy and Water Development, Military Construction and Veterans Affairs, and Legislative Branch Appropriations Minibus (H.R.5895/P.L. 115-244), including funding for DOE offices of Energy Efficiency and Renewable Energy (EERE), Fossil Energy (FE) and Electricity Delivery and Energy Reliability (EDER), and the new cybersecurity office. The Environmental Protection Agency, including at the Office of Air and Radiation and Energy Star and climate programs (S.3073/H.R.6147) International climate finance and climate programs at the Department of State (S.3108/H.R.6385). Advocacy in support of the following pieces of legislation: The Disaster Recovery Reform provisions of the FAA Reauthorization bill (H.R.302/ Pub.L. 115-254). Meetings with Hill staff regarding implementation of the legislation. Energy programs in the Farm Bill Reauthorization legislation, the Agriculture Improvement Act of 2018 (H.R.2/PL115-334). Advocacy on the following clean energy tax extenders: The Renewable Electricity Tax Credit Equalization Act, H.R. 4137, which would address an inequity for certain renewable energy technologies including: biomass, geothermal, landfill gas, waste to energy, hydropower, marine and hydrokinetic energy. S. 1868, and H.R. 4649, which would clarify that the entire portfolio of energy storage (i.e., grid batteries, pumped hydro, thermal storage) qualifies for 48 and 25D investment tax credit as a standalone, eligible advanced energy technology. Provide parity and accelerate the adoption of fuel cell electric vehicles and plug-in electric vehicles. There have been several bills introduced in the 115th Congress, on both sides of the aisle, that would extend and/or modify the 30B, 30C, or 30D federal tax credits. S. 1409, the Technologies for Energy Security Act, specifically Sections 3(a) and (c), as well as S. 2256, the Tax Extenders Act of 2017, specifically Sections 311(a) and (c), to allow commercial geothermal to qualify for the same 48 tax credit commercial solar can utilize. S. 1409 also included waste heat to power (WHP) while the House bill, H.R. 1090, did not. S. 1409 should be the model for WHP language. Amend the PTC under Section 45 of the Internal Revenue Code to allow for more efficient usability of the credits, such as credit refundability and tax credit transferability. Extend a range of energy efficiency-related tax credits, with certain updates and modifications to promote high-efficiency measures including: the 179D Energy Efficient Commercial Building Tax Deduction, which promotes energy efficiency in commercial and multifamily buildings, the 25C Nonbusiness Energy Property Credit that incentivizes homeowners for efficiency upgrades and equipment purchases such as weatherizing or installing new windows or more efficient heating and cooling equipment, and the 45L Energy Efficient Home Credit. The Clean Energy Business Network (CEBN), an independent initiative of the BCSE, also engages in lobby activity. The CEBN's lobbying activities and expenditures are included in the BCSE's quarterly LD-2 filings. CEBN's activity includes information gathering and advocacy on federal tax reform; extensions of expired clean energy tax credits; appropriations for the Department of Energy and related programs at other federal agencies; and energy-related programs within Farm Bill Legislation. The CEBN also participated in information gathering and building awareness before Congress on examples of small and medium-sized businesses across the nation contributing to the clean energy economy. The BCSE also provides administrative service to the Federal Performance Contracting Coalition (FPCC), a coalition of federal energy services contract holders. The FPCC's lobbying activities and expenditures are included in the BCSE's quarterly LD-2 filings. Cascade Associates is a lobbyist for the FPCC. The FPCC contacted: The House of Representatives, Senate, Department of Energy, Office of Management and Budget, Government Services Administration, Council on Environmental Quality, Department of Veterans Affairs, Departments of Navy, Army, and Air Force and the Offices of the Secretary of Defense. The FPCC is working with Members of Congress in developing complimentary policy for Energy Savings Performance Contracting (ESPC.) Specifically, the provided input on language in the Energy Savings Through Public-Private Partnerships Act of 2017 (H.R. 723 and S. 239) and FPCC lobbied for execution of the Presidents Executive Order 13834 Regarding Efficient Federal Operations. They met with members of the Armed Services Committees, Appropriations Committees, House Energy and Commerce Committee, and Senate Energy and Natural Resources Committee.

Promote & protect the interests of natural gas utilities in any legislation considered by the House Energy & Commerce Committee and the Senate Energy & Natural Resources Committee regarding energy and climate legislation affecting natural gas utilities, including efficiency mandates and NGV Market Development. These issues arose in all of the following: S. 1460 - Energy and Natural Resources Act of 2017 (ENRA) - The Senate energy bill includes many provisions that AGA supports, such as: a provision to repeal of fossil phase-out for federal buildings; a provision to extend the maximum potential contract period of utility energy service contracts from 10 to 25 years; a provision to amend contracting authority and reporting in Energy Conservation Policy Act (ECPA) to encourage Federal agencies to enter into energy savings performance contracts and utility energy service contracts to implement energy and water conservation measures at Federal buildings; a provision to revise how DOE modifies the definition of covered products for energy efficiency standards making; a provision to require DOE to provide an opportunity for public input prior to the issuance of a proposed rule for energy efficiency standard making; a provision to incentivize automakers to make more natural gas vehicles; a provision to require DOE to conduct a study of existing rules and procedures relating to interconnection service and identify barriers to the deployment of Combined Heat and Power (CHP) and Waste Heat to Power (WHP) systems; S. 1180 - Clean Energy Grid Act - would create a competitive grant program to demonstrate the integration of smart grid technologies (such as combined heat and power) open to state and local agencies, public and private institutions, electric and natural gas utilities, and equipment manufacturers. S. 239 - Energy Savings Through Public-Private Partnerships Act of 2017 - encourages the use of Energy Savings Performance Contracts (ESPCs) and Utility Energy Savings Contracts (UESCs) in federal buildings. Mandatory federal audits already outline energy savings projects for federal facilities aimed at reducing energy consumption and saving tax dollars; however, federal agencies are currently not required to implement these changes. This legislation changes that and would allow projects to be paid for by ESPCs or UESCs. ESPCs and UESCs are innovative public-private partnerships in which private companies use their own money and resources to make energy efficiency upgrades to federal buildings. In exchange for making energy efficient upgrades, those private companies receive a portion of the money saved as a result of the increased efficiency in federal buildings. ESPCs and UESCs create private sector jobs upgrading the federal governments estimated three billion square feet of office space at no real cost to taxpayers. H.R. 723 - Energy Savings Through Public-Private Partnerships Act of 2017 - House version of S. 239. (See above) S. 385 - Energy Savings and Industrial Competitiveness Act - also known as the Portman-Shaheen energy efficiency bill. This bill includes a provision that would repeal Section 433, a ban on fossil fuel-generated energy in Federal buildings. H.R. 1443 - Energy Savings and Industrial Competitiveness Act - also known as the McKinley-Welch energy efficiency. This bill is the House champion to S. 385. This bill includes a provision that would repeal Section 433, a ban on fossil fuel-generated energy in Federal buildings.
