Generally supported federal biofuel programs. Encouraged introduction of legislative reforms to the Renewable Fuel Standards (RFS) that help develop cellulosic feedstocks for use in distillate fuel markets and increase supplies of biomass-based diesel fuels in the Northeast. This includes legislation to expand the definition of renewable biomass (S.1614) and reform advance biofuels pathways (S.3986). NEFI opposed use of Small Refinery Exemptions from the Renewable Fuels Standard. It also supported the RFS Integrity Act (H.R.3006 and S.1840), the Clean Fuels Deployment Act (H.R.6671), and pandemic-related financial assistance for biofuel producers and feedstock growers, including Section 60305 of the House-passed HEROES Act (H.R.6800), Section 305 the second HEROES Act (H.R.8406), and the Renewable Fuel Feedstock Reimbursement Act (S.3756).

Urged the President and members of Congress to provide support to ethanol producers in phase four economic stimulus legislation; pushed for direct aid to biofuel producers, and for more specific language directing the use of USDA funds to ethanol producers. Encouraged DOJ to advise against Supreme Court review of the Tenth Circuit Court's ruling that invalidated several small refinery exemptions (SREs) issued by EPA under the RFS. Submitted comments to EPA's E85 Flexible Fuel Vehicle Weighting Factor (F-factor) for Model Year 2021 and Later Vehicles, supporting an F-factor of at least 0.20 for model year 2021 and later vehicles, and encouraging EPA to consider forward-looking data which indicate E85 use will significantly rise in the future. Supported the Renewable Fuel Feedstock Reimbursement Act of 2020 (S. 3756), a bill that would reimburse biofuel producers for a share of feedstocks they purchased and processed into renewable fuel during the first quarter of the year. Supported the Adopt GREET Act (S. 4481), a bill to require EPA to update its decade-old greenhouse gas lifecycle modeling for ethanol and biodiesel. Encouraged updates to the Next Generation Fuels Act of 2020 (H.R. 8371), a bill to support high octane fuel, limit aromatics in gasoline, ensure all blends above 10 percent ethanol receive the same RVP treatment as E10, and require future vehicles and retail fuel stations to be compatible with E30, among other things. Supported S. 3986, a bill that would help approve certain Renewable Fuel Standard (RFS) pathway applications, like corn fiber, which help reduce greenhouse gas (GHG) emissions. Supported S. 3938, the Hand Sanitizer Guidance Extension Act of 2020 to extend for two years The Food and Drug Administrations (FDA) Temporary Policy for Preparation of Certain Alcohol-Based Hand Sanitizer Products During the Public Health Emergency. This would support continued production of ethanol for hand sanitizer at a time of high demand and reported shortages to help reduce the transmission of COVID-19. Worked with USDA staff to provide retailers with continued guidance in applying for the Higher Blends Infrastructure Incentive Program (HBIIP), which was re-opened in December.

Urged the President and members of Congress to provide support to ethanol producers in phase four economic stimulus legislation; sent a letter to Senators Schumer and McConnell asking for direct aid to biofuel producers, and for more specific language directing the use of USDA funds to ethanol producers. Discouraged EPA from pursuing "gap year" small refinery exemptions (SREs) under the Renewable Fuel Standard (RFS); EPA denied the exemptions in September. Joined the Urban Air Initiative, a coalition of state corn grower organizations, and the Clean Fuels Development Coalition in filing comments asking EPA not to penalize ethanols ability to reduce carbon emissions in response to a notice of public rulemaking on Tier 3 certification test fuel. Joined the Urban Air Initiative (UAI) and 10 state corn grower organizations in submitting comments to EPA on its "Anti-Backsliding" study, urging EPA to use improved data and real-world test fuels in the MOVES model. Supported the Renewable Fuel Feedstock Reimbursement Act of 2020 (S. 3756), a bill that would reimburse biofuel producers for a share of feedstocks they purchased and processed into renewable fuel during the first quarter of the year, and making the case to include the plan for direct aid in the next coronavirus aid package. Supported the Adopt GREET Act (S. 4481), a bill to require EPA to update its decade-old greenhouse gas lifecycle modeling for ethanol and biodiesel. Assisted in the development of the Next Generation Fuels Act of 2020 (H.R. 8371), introduced by Congresswoman Bustos; the bill would support high octane fuel, limit aromatics in gasoline, ensure all blends above 10 percent ethanol receive the same RVP treatment as E10, and require future vehicles and retail fuel stations to be compatible with E30, among other things. Supported S. 3986, a bill that would help approve certain Renewable Fuel Standard (RFS) pathway applications, like corn fiber, which help reduce greenhouse gas (GHG) emissions. Generally supported federal biofuels programs. Encouraged introduction of legislative reforms to the Renewable Fuel Standards (RFS) that help develop cellulosic feedstocks for use in distillate fuel markets and increase supplies of biomass-based diesel fuels in the Northeast. Opposed use of Small Refinery Exemptions and supported related legislation including the RFS Integrity Act, H.R.3006 and S.1840. Supported the Clean Fuels Deployment Act (H.R.6671) and pandemic-related financial assistance for biofuel producers and feedstock growers, including Section 60305 of the House-passed HEROES Act (H.R.6800) and the Renewable Fuel Feedstock Reimbursement Act (S.3756).

Urged the President and members of Congress to provide support to ethanol producers in the series of economic stimulus packages. ACE worked with members of Congress to include a provision that would establish a new Renewable Fuel Reimbursement Program at the U.S. Department of Agriculture (USDA) in the phase four stimulus package (HEROES Act). Urged the U.S. Department of Agriculture (USDA) to utilize its authority and allocation of additional funds provided to the Commodity Credit Corporation through the Coronavirus Aid, Relief, and Economic Security (CARES) Act to aid ethanol producers suffering from the economic fallout of the COVID-19 pandemic. Discouraged EPA from pursuing "gap year" small refinery exemptions (SREs) under the Renewable Fuel Standard (RFS). Joined a coalition of agriculture and biofuel groups on a letter to EPA requesting additional information on "gap year" filings. Supported S. 3756, the Renewable Fuel Feedstock Reimbursement Act of 2020, a bill that would reimburse biofuel producers for a share of feedstocks they purchased and processed into renewable fuel dating back to the first quarter of the year. Worked with USDA staff to provide retailers with a comprehensive guide to applying for the Higher Blends Infrastructure Incentive Program (HBIIP). Joined a coalition of ag and biofuel groups on a letter to EPA opposing the American Petroleum Institutes recent petition requesting reconsideration of the 2020 Renewable Fuel Standard (RFS) final rule.
