Consolidated Appropriations Act, 2018
Client: NATIONAL CLUB ASSOCIATION · Firm: NATIONAL CLUB ASSOCIATION
NCA lobbied for the inclusion of language in H.R. 1625, the Consolidated Appropriations Act, that would have helped remove the Environmental Protection Agency's Waters of the U.S. regulation. That regulation will cause private clubs to secure permits before using fertilizers and pesticides on golf course greens and fairways. The additional time, money and resources expended to secure those permits will have a significant impact on smaller club's bottom lines. The language was not included in the final bill.

Delay of health insurance tax implemented under the ACA.
Increasing limits on H2-B visas. Joint Employer definition and overtime.
Source: Senate LDA
NCA lobbied on behalf of H.R. 1625, the Consolidated Appropriations Act. This legislation included provisions that increased the H-2B visa program's cap limit. When American workers are unwilling to take on these seasonal positions, clubs turn to the H-2B program. Without these workers, many clubs are unable to fully staff their facilities. This provision was included in the final bill. NCA also lobbied on H.R. 1625 for legislative language that would have overturned the National Labor Relations Board's "Joint Employer" decision. This language would have returned the definition of a joint employer to the standard used prior to the NLRB's ruling in 2015. This language was not included in the final bill. NCA also lobbied for H.R. 3956, the Simplifying Technical Aspects Regarding Seasonality Act. This legislation will remove the two different definitions for seasonal staffers currently found in the Affordable Care Act. By so doing, club leaders will better understand who must be counted when determining if their facility has 50 or more full-time or full-time equivalent employees and who is then required to be offered health insurance under the law.

When American workers are unwilling to take on seasonal positions, clubs turn to the H-2B program. Without these workers, many clubs are unable to fully staff their facilities. The language we supported in the appropriations bill was included in the final legislation. That bill has not yet been voted on by the full House. Client: NATIONAL CLUB ASSOCIATION · Firm: NATIONAL CLUB ASSOCIATION
NCA lobbied on behalf of HR 1628, the American Health Care Act, and the Senate's healthcare bill entitled the Better Care Reconciliation Act (no bill number assigned yet). In each bill, the legislative language would remove the Employer Mandate found in the Affordable Care Act. This mandate has placed a significant burden on the club industry while failing to reduce insurance premiums for club employees. HR 1628 has passed the House of Representatives and the Senate bill is still pending.
Strengthen Employment And Seasonal Opportunities Now (SEASON) Act
Client: NATIONAL CLUB ASSOCIATION · Firm: NATIONAL CLUB ASSOCIATION
NCA lobbied on behalf of S. 792, the Save Our Small and Seasonal Businesses Act, and H.R. 2004, the House version of that bill. This legislation will re-institute the H-2B visa program's Returning Worker Exemption, which will allow those who have used the visa program in the past to return without counting against the H-2B visa cap limit. When American workers are unwilling to take on these seasonal positions, clubs turn to the H-2B program. Without these workers, many clubs are unable to fully staff their facilities. Client: NATIONAL CLUB ASSOCIATION · Firm: NATIONAL CLUB ASSOCIATION
NCA lobbied on behalf of HR 2004, the Strengthen Employment and Seasonal Opportunities Now Act, and S 792, the Save Our Small and Seasonal Businesses Act. Each bill would provide further relief for the club industry as it tries to secure temporary seasonal workers through the H-2B visa program. When American workers are unwilling to take on these seasonal positions, clubs will turn to the H-2B program. Without these workers, they are unable to fully staff their facilities. Each bill is still pending. NCA also lobbied for the Simplifying Technical Aspects Regarding Seasonality Act (the bill has not yet been introduced in the 115th Congress). This legislation would remove the two different definitions for seasonal staffers currently found in the Affordable Care Act. By so doing, club leaders would better understand who must be counted when determining if their facility has 50 or more full-time or full-time equivalent employees and who is then required to be offered health insurance under the law. This is a technical corrections bill that may not need to be introduced if the American Health Care Act or the Better Care Reconciliation Act passes both chambers and is signed into law. Finally, NCA is lobbying on behalf of appropriations riders that would remove funding for the enforcement of certain regulations established by the National Labor Relations Board in FY18. These riders would ensure that clubs had the time necessary to prepare for a union election by removing funding for the Ambush Election Rule as well as ensure an appropriate bargaining unit was created before an election is held by removing funding for the Micro-Union Rule.

Regulatory Accountability Act of 2017
Client: NATIONAL CLUB ASSOCIATION · Firm: NATIONAL CLUB ASSOCIATION
NCA engaged in discussions regarding potential regulatory action that would remove the Environmental Protection Agency's Waters of the U.S. regulation. That regulation would have caused the club industry to secure permits before using fertilizers and pesticides on golf course greens and fairways. The additional time, money and resources expended to secure those permits would have had a significant impact on smaller clubs' bottom lines. No specific legislation was introduced, but the administration has begun the process of removing this regulation. NCA also lobbied on behalf of HR 5, the Regulatory Accountability Act, and HR 998, the Searching for and Cutting Regulations that are Unnecessarily Burdensome Act. HR 5 will help ensure more stakeholder input is provided before regulatory agencies finalize new regulations. HR 998 will enable regulatory agencies to remove rules that no longer apply based on changing times or business environment. Each bill will enable clubs to grow by ensuring the interests of those affected are more adequately considered before the regulation is finalized and by ensuring that antiquated regulatory mandates are removed. Each bill passed the House of Representatives.

To make permanent the returning worker exception to the annual numerical limitation on nonimmigrant visas issued under section 101(a)(15)(H)(ii)(b) of the Immigration and Nationality Act, and for other purposes.
Client: NATIONAL CLUB ASSOCIATION · Firm: NATIONAL CLUB ASSOCIATION
NCA lobbied against DOL's proposed regulation that will change the requirements necessary for workers to be exempt from overtime. If these changes are finalized, they will lower employees' pay and benefits, force employees from salaried positions into hourly positions, limit advancement opportunities for employees and force clubs to alter staff schedules at their facilities. NCA lobbied for an appropriations rider that will remove funding for this rule in FY17 should it be finalized without substantive changes that help both employees and employers. NCA also lobbied for the passage of H.R. 3918 and S. 2225, the Strengthen Employment and Seasonal Opportunities Now Act and H.R. 2758, the Save Our Small and Seasonal Businesses Act. Each of these bills will make permanent the recently passed temporary fixes to the DOL's/DHS' H-2B visa program. Without these permanent changes to the program, it will be more difficult for clubs to secure temporary foreign workers when American workers are unable or unwilling to do the work.

These modifications will allow clubs to better afford the change in the minimum weekly salary threshold and help minimize concerns for their employees. Save Our Small and Seasonal Businesses Act of 2015
Client: NATIONAL CLUB ASSOCIATION · Firm: NATIONAL CLUB ASSOCIATION

Overtime Reform and Review Act
Client: NATIONAL CLUB ASSOCIATION · Firm: NATIONAL CLUB ASSOCIATION
NCA lobbied for S. 3464, the Overtime Reform and Review Act. This bill provides a phase-in of the minimum weekly salary threshold approved by DOL in its Overtime Exemption Rule. Also, the bill removes the automatic increase to the weekly threshold found in the rule. These modifications will allow clubs to better afford the change in the minimum weekly salary threshold and help minimize concerns for their employees. Additionally, NCA lobbied for an appropriations rider that would renew the H-2B visa program's returning worker exemption. NCA lobbied on behalf of H.R. 30, the Save American Workers Act, and S. 30, the Forty Hours is Full Time Act. These bills will change the definition of full-time employee found in the Affordable Care Act from one who works 30 hours per week to one who works 40 hours per week. With this change, NCA members will minimize health insurance costs that otherwise could cause them to reduce hours for employees or layoff workers. NCA also lobbied for H.J. Res. 29 and S.J. Res. 8, a Joint Resolution of Congressional Disapproval for the new NLRB union election rule. The new rule would allow union organizing elections to take place within 10-15 days from the date a union petition is filed with the NLRB. Such a limited amount of time between filing the petition and holding the election would mean employers would have no chance to prepare for a union election and employees would have no time to learn all of the facts of union representation before having to vote. The measure passed the House and Senate but was vetoed by the President.

Client: NATIONAL CLUB ASSOCIATION · Firm: NATIONAL CLUB ASSOCIATION
NCA lobbied for H.R. 1732, the Regulatory Integrity Protection Act and S. 1140, the Federal Water Quality Protection Act. These bills would mandate changes to the EPA's Waters of the U.S. Rule. This rule could place golf course waterways and ponds under the control of the Clean Water Act for the very first time. Should this regulation go forward without any changes, private golf and country clubs would be forced to refrain from using certain chemicals and fertilizers without first securing permits from the EPA. In addition to permitting requirements, this new rule would add numerous regulatory burdens on clubs that could impact their bottom lines and cause a loss of jobs in the club industry.

The bill will change the definition of full-time employee found in the Affordable Care Act from 30 hours per week to 40 hours per week. With this change, NCA member clubs will minimize health insurance costs that otherwise could cause them to reduce hours for employees or layoff workers. NCA also lobbied for HR 4238, a bill to stop the Department of Labor (DOL) from implementing any further changes to the H-2B visa program. DOL plans to issuea new wage rule that would make the program too expensive for NCA member clubs to use. This bill would prohibit that from happening and prohibit a proposed H-2B overhaul rule from being issued by DOL. Without this legislation, NCA member clubs would be left unable to fully staff their facilities during their high seasons. Also, NCA lobbied for passage of the Workforce Democracy Fairness Act, HR 4320. This bill would prohibit the National Labor Relations Board's Ambush Election Rule from being implemented. That rule would allow union organizers to hold an election within 10-21 days from the day the election petition is filed. Such a time frame would make it impossible for NCA member clubs to defend against the union campaign and it would limit the ability of NCA member clubs' employees to understand what union representation would really mean. Finally, NCA lobbied for a technical correction to the Affordable Care Act as it relates to seasonal workers. NCA member clubs use a tremendous number of such workers and the current language in the law and regulations provide two separate exemption periods for these workers and a confusing and complex set of requirements for counting these workers. To ensure compliance with the law when it applies to these workers, we have supported making a change to the law. No bill has yet to be introduced but we have lobbied for such legislation.

NCA also lobbied on behalf of S. 792, the Save Our Small and Seasonal Businesses Act and H.R. 2004, the Strengthen Employment and Seasonal Opportunities Now Act. These bills would also have increased the cap limit for the H-2B Visa Program. They did not pass.

In addition to permitting requirements, this new rule would add additional regulatory burdens that could impact clubs' bottom lines and cause a loss of jobs in the private club industry.

NCA also lobbied for S 1284, the Labor, Health and Human Services, Education Appropriations bill. The bill would have removed funding for the H-2B Visa Wage Rule for another year. Finally, NCA lobbied for HR 2752. The bill excludes seasonal workers from the determination of whether a private club is anapplicable large employer under the new healthcare reform law. By removing seasonal workers from this equation, many private clubs would not fall under the healthcare reform law and would be relieved from the costs associated with that law.

Under the CWA, private golf and country clubs will be forced to refrain from using standard and traditional pesticides and fertilizers without first securing permits from the EPA. With this change, NCA members will minimize health insurance costs that otherwise could cause them to reduce hours for employees or layoff workers. NCA also lobbied against DOL's proposed regulations that will change the requirements necessary for workers to be exempt from overtime. If these changes are finalized, they will lower employees' pay and make it difficult for clubs to staff their facilities.
Filing targets: HOUSE OF REPRESENTATIVES, Labor, Dept of (DOL), SENATE
NCA lobbied for H.R. 928/S. 183, a bill to repeal the annual tax imposed on health insurance providers for selling insurance policies. This health insurance tax is found in the Affordable Care Act and the cost will be passed on to those purchasing the insurance policies. Thus, it is a new tax on private clubs that will further impact their bottom lines and potentially lead to job losses in the club industry.
NCA lobbied for H.R. 863, the Simplifying Technical Aspects Regarding Seasonality Act of 2015. This bill will simplify compliance with the Affordable Care Act for private clubs that hire seasonal workers. Without this legislation, clubs will likely encounter unintended compliance errors with the healthcare law and their seasonal employees.

NCA lobbied the EPA to remove and amend it proposed Waters of the U.S. Rule. The rule could place golf course waterways and ponds under the control of the Clean Water Act for the very first time.

NCA lobbied for H.R. 4238, a bill to stop the Department of Labor (DOL) from implementing any further changes to the H-2B Visa Program. DOL has issued a new wage rule that would make the program too expensive for private clubs to use. This bill would prohibit the rule from taking effect.

NCA lobbied for HR 4238, a bill to stop the Department of Labor (DOL) from implementing any further changes to the H-2B Visa Program. DOL has issued a new wage rule that would make the program too expensive for NCA members to use. This bill would prohibit that. Additionally, NCA lobbied for an amendment to the Senate's FY15 Appropriations Bill for DOL that would prohibit funding for the new wage rule. The appropriations bill has not been voted on yet. NCA also lobbied on behalf of the Save American Workers Act, HR 2575. The bill will change the definition of full-time employee found in the Patient Protection and Affordable Care Act from 30 hours per week to 40 hours per week. With this change, NCA members will minimize health insurance costs that otherwise could cause them to reduce hours for employees or layoff workers.

NCA lobbied for S 744, the Border Security, Economic Opportunity and Immigration Modernization Act. The bill increases the number of H-2B visas available for private clubs and it provides a new lower-skilled foreign worker visa. Additionally, the bill provides strong employment verification measures to ensure all workers in every industry are authorized to work in the United States. This will ensure that private clubs are not competing against businesses that are gaming the current system to their advantage.
Filing targets: HOUSE OF REPRESENTATIVES, SENATE
NCA lobbied against the implementation of the new H-2B Visa Program Wage Rule issued by the Department of Labor and the Department of Homeland Security. This new rule increases costs for private clubs and makes the federal program far less likely to be used. NCA lobbied for HR 1120, the Preventing Greater Uncertainty in Labor-Management Relations Act. The bill prohibits the National Labor Relations Board from conducting any further business until its board composition is deemed constitutionally valid.

NCA lobbied for the inclusion of specific language in the Department of Labor appropriations bill prohibiting funding for the implementation of the Department's new H-2B visa program wage regulation and its new H-2B visa program operations regulations. Each of these regulations will dismantle the entire H-2B visa program and significantly impact private clubs as they seek temporary, seasonal workers to staff their facilities during peak usage times. NCA also lobbied for the inclusion of specific language in the Department of Labor appropriations bill prohibiting funding for the implementation of the National Labor Relations Board's new union organizing regulations and the Department's new employer disclosure regulations for businesses that hire professional to assist with the legal and technical aspects of a union organizing campaign. Each of these regulations will greatly simplify the union organizing process for unions to the detriment of private clubs and will lead to significantly increased costs for the private club industry.

NCA lobbied against the H-2B Program Reform Act because it will limit the program for our members. Also, H.R. 1409 and S. 560 - the Employee Free Choice Act of 2009. NCA lobbied against the passage of these bills because the legislation will simplify the process by which unions could begin organizing in businesses which will drastically impact the ability of our members to remain viable entities.

NCA lobbied against all but H.R. 7006 because each of those bills excluded private golf and country clubs from receiving tax breaks that would aid in a business' recovery following a natural disaster. H.R. 7006 did not exclude our industry from receiving those tax breaks.
S. 2818 - the Small Business Health Plans Act and S. 2795 - the Small Business Health Options Programs Act. NCA lobbied for the passage of S. 2818 and the defeat of S. 2795.
