U.S. Citizenship Act This bill establishes a path to citizenship for certain undocumented individuals. The bill also replaces the term alien with noncitizen in the immigration statutes and addresses other related issues. Specifically, the bill establishes a new status of lawful prospective immigrant . This status shall be available to an applying noncitizen who meets certain requirements, including being continually present in the United States from January 1, 2021, and passing background checks. After at least five years with this status, an eligible noncitizen may apply for and receive permanent resident status. The bill also provides permanent resident status to certain applying noncitizens, specifically for eligible noncitizens who (1) entered the United States as a minor, (2) were eligible for temporary protected status or deferred enforced departure on January 1, 2017, or (3) worked a certain amount of agricultural labor in the five years prior to applying. Among other things, the bill also redefines for immigration purposes the term conviction to exclude convictions that have been expunged or vacated, requires the Department of State to implement a strategy to advance reforms in Central America and address key factors contributing to migration from the region to the United States, requires the State Department to establish refugee processing centers in Central America, requires Customs and Border Patrol sectors and stations to have a certain number of employees with certain qualifications such as paramedic training, generally prohibits religious discrimination in granting or denying immigration benefits, and establishes grant programs for providing training and services to immigrants.

The Equal Access to Green cards for Legal Employment Act (EAGLE Act) would phase out the country cap limitations on the number of green cards available to high-skilled workers from a particular country. Under current policy, only 7% of green cards can be issued in a year to nationals from a given country, regardless of its population. The EAGLE Act (H.R. 3648) would also strengthen the H-1B temporary program and allow individuals who have been in the queue for a green card for two years to file an application with approval pending the availability of a visa. U.S. Citizenship Act of 2021 (HR 1177) (Would make sweeping change to the United States immigration, visa, and border control system, including reversal and Congressional prohibition of many of the immigration-related executive actions of the previous administration; providing a path to legal residence for current DACA dreamers and others, essential workers in non-immigrant status, ending country-specific visa annual limits; granting immediate relative status to spouses and children of green card holders; and including other green card changes to recapture visas and exempt STEM degrees) U.S. House Committee on the Judiciary Subcommittee on Immigration and Citizenship (Modernize the Nonimmigrant and Immigrant Employment-Based System with E-Filing. As a first step to green card reform, eliminate the employment-based per country green card limits to create a first-come first-served green card system. Increase certainty and efficiency with a Trusted Employer program to pre-certify immigration-compliant employers, saving resources for top government priorities) Modifying then Registration Requirement for Petitioners Seeking to File Cap-Subject H-1B Petitions; Delay of Effective Date, 86 Fed. Reg. 7656 (Delay of effective date of final rule of a wage-based H-1B lottery process until December 31, 2021 proposed in the Department of Homeland Security) Strengthening Wage Protections for the Temporary and Permanent Employment of Certain Aliens in the United States: Proposed Delay of Effective Date, 86 Fed. Reg. 7656 (February 1, 2021) [DOL Docket No. ETA-2020-0006] (Delay until May 14 of effective date of final rule to change required wage computations for occupational immigration programs). Identifying Barriers Across U.S. Citizenship and Immigration Services (USCIS) Benefits and Services; Request for Public Input, 86 Fed. Reg. 20398 (April 19, 2021).
