Lower Food and Fuel Costs Act This bill addresses provisions related to agriculture, food, and fuel, including by providing funds for nutrient management, precision agriculture, and biofuel infrastructure. Specifically, the bill provides funding for the Department of Agriculture (USDA) to (1) assist agricultural producers with the costs of crop nutrient use or adopting precision agriculture practices, and (2) provide grants to eligible entities (e.g., fueling and distribution facilities) for biofuel infrastructure. The bill establishes within USDA the Office of the Special Investigator for Competition Matters, which must investigate and prosecute violations of the Packers and Stockyards Act of 1921 by packers and live poultry dealers. Additionally, USDA must (1) establish an agriculture and food supply chain task force, and (2) provide assistance to address fertilizer shortages and reduce dependency on foreign sources for fertilizer. The bill allows USDA to make loans and grants for livestock and poultry processing. Further, the bill incorporates support for precision agriculture into various USDA programs. USDA's Agricultural Marketing Service must enter into certain cooperative agreements for establishing supply chain regional resource centers to support small- and medium-sized producers of agricultural products and agricultural businesses. The bill also applies the Reid vapor pressure (a measure of gasoline's volatility) requirements that are applicable to gasoline blended with 10% ethanol (E10) to gasoline blended with more than 10% ethanol. Thus, the waiver given to E10 gasoline, which allows an increase in the Reid Vapor Pressure volatility, is extended to gasoline blended with more than 10% ethanol.

Michigan Farm Bureau has communicated with the House and Senate opposing House-added sections of the America COMPETES Act that ban the farming and trade of American mink and significantly amend the Lacey Act. This would be detrimental to farmers raising mink and all of animal agriculture. Michigan Farm Bureau communicated with the House and Senate Agriculture Committees on S. 4030, the Cattle Price Discovery and Transparency Act. Farm Bureau generally supported the bill, but opposed a provision in Section 2 and Section 7 which would establish a mandatory minimum order under which certain percentages of cattle are purchased. Farm Bureau also expressed support for the following livestock bills with the Ag Committees: H.R. 7764: directs the Secretary of Agriculture to provide additional payments under the Environmental Quality Incentives Program (EQIP) for nutrient management practices. H.R. 2518, the PRECISE Act: would allow for the use of EQIP dollars to be used for the adoption of precision agriculture technology for the purpose of participating in the EQIP program. H.R. 2606, the SUSTAINS Act: would establish public-private partnership contribution accounts within NRCS to incentivize private funding by awarding dollars to targeted conservation initiatives that would improve land use for sequestering carbon, wildlife habitat, water quality, and other practices that promote the conservation of natural resources. H.R. 4140, the BUTCHER BLOCK Act: would help drive competition by establishing a loan program at USDA Rural Development that would allow for the development of new and expanding processing facilities. Farm Bureau policy is generally supportive of enhanced enforcement of the Packers and Stockyards Act and our members support adequate funding and staff at USDA to carry out the mission. However, Farm Bureau has reservations regarding how H.R. 7606, the Meat and Poultry Special Investigator Act would be implemented and did not offer support.

Supported H.R. 7606, the Lower Food and Fuel Costs Act, a bill to extend Reid vapor pressure (RVP) limit relief to blends of gasoline containing more than 10 percent ethanol, which would ensure uninterrupted market access to E15 in all parts of the country, and which includes the Year-Round Fuel Choice Act and the Renewable Fuel Infrastructure Investment and Market Expansion Act to provide more biofuels infrastructure funding. After the release of the Renewable Volume Obligations (RVOs) for the 2021 and 2022 Renewable Fuel Standard (RFS) compliance years, encouraged EPA to use the set rule for post-2022 volumes to make good on Administrator Regans statement that biofuels will be a part of the solution for climate change and lowering prices at the pump. Thanked EPA Administrator Regan for issuing a national, temporary emergency waiver so E15 can continue to be sold this summer, which will help increase fuel supplies, give consumers more choice and lower prices, and provide savings at the pump. Thanked President Biden for announcing biofuel infrastructure funding and distributions, as well as $700 million in biofuel aid, to be awarded in April. Supported EPAs decision to reverse 31 small refinery exemptions (SREs) originally granted in 2019, but opposed EPA allowing the refineries to not have to meet their obligations through blending biofuel or retiring RIN credits. Submitted comments to EPA on the current scientific understanding of greenhouse gas (GHG) modeling of land-based crop biofuels, encouraging EPA to update the methodology it uses to account for the lifecycle GHG emissions of ethanol and other biofuels to properly credit their GHG benefits to meet climate goals. Supported S. 3787 and H.R. 7155, the "Home Front Energy Independence Act," bills to allow sales of E15 year-round, establish an E15 tax credit, direct EPA to finalize their E15 labeling rule, and provide for biofuel infrastructure and compatibility with retailers. Supported H.R. 4410 and S. 2339, bills that clarify E15 should be allowed for sale year-round by extending the 1-psi Reid vapor pressure (RVP) waiver to fuel blends containing gasoline and over 10 percent ethanol. Supported H.R. 1637 and S. 218, bills to expedite the approval process for renewable fuels under the renewable fuel standard (RFS) program. The bills consider an application to register a renewable fuel under the RFS program to be approved by the Environmental Protection Agency (EPA) if the fuel has been approved under any state renewable fuel program. They also establishes a deadline for the EPA to make a decision on any pending application for a renewable fuel that has not yet been approved under any state program and establishes deadlines for the EPA to make decisions on pending pathway petitions by producers to register biofuels. Supported S. 193 and H.R. 3593, the Adopt GREET Act, which would require EPA to update its outdated lifecycle modeling for ethanol and biodiesel, specifically by adopting the latest Argonne National Labs Greenhouse Gas and Regulated Emissions and Energy Use in Transportation (GREET) Model. Supported H.R. 1113, the Renewable Fuel Standard Integrity Act, legislation that addresses the timing and transparency issues associated with the small refinery exemption (SRE) program under the Renewable Fuel Standard (RFS). Opposed H.R. 190, the Leave Ethanol Volumes at Existing Levels (LEVEL) Act, legislation to repeal the Renewable Fuels Standard II (RFS), leaving RFS I levels intact. Supported S. 2262/H.R. 4254, bills to establish an income tax credit for the sale or blending of certain fuels containing ethanol. Supported the Defend the Blend Act (S. 3380 and H.R. 6071), bipartisan legislation to prohibit the U.S. Environmental Protection Agency (EPA) from retroactively reducing Renewable Volume Obligations (RVO) levels once they are finalized, including the 2020 RVOs. Opposed S. 2385 and H.R. 7484, the Corn Ethanol Mandate Elimination Act, bills to eliminate the Renewable Fuel Standard (RFS).
