Energy Choice Act
Client: AIR CONDITIONING CONTRACTORS OF AMERICA · Firm: AIR CONDITIONING CONTRACTORS OF AMERICA
Advocated for H.R. 3699 and S. 1945, the Fuel Choice Act, which would prohibit states and localities from banning an energy service's connection, reconnection, modification, installation, or expansion based on the type or source of energy to be delivered. Advocated for S. 5338, the Energy Efficiency Reform Act of 2026, introduced by Senator Mike Lee, and H.R. 4626, the Home Appliance Protection and Affordability Act, introduced by Representative Rick Allen, both of which would reform the Energy Policy and Conservation Act (EPCA). These bills seek to strengthen requirements that Department of Energy appliance efficiency standards be technologically feasible and economically justified, while protecting consumer choice, product affordability, and availability. Both bills would eliminate the mandatory six-year review cycle for energy conservation standards and establish mechanisms for revising or repealing existing standards. H.R. 4626 would also strengthen economic and consumer cost considerations in DOE rulemaking and revise compliance timelines, while S. 5338 would codify additional rulemaking procedures, clarify product classification requirements, and strengthen federal preemption of state and local restrictions on covered appliances based on fuel source or emissions.

Advocated for H.R. 3699 and S. 1945, the Fuel Choice Act, which would prohibit states and localities from banning an energy service's connection, reconnection, modification, installation, or expansion based on the type or source of energy to be delivered. Advocated for H.R.4626 Home Appliance Protection and Affordability Act, which amends the Energy Policy and Conservation Act. This bill would require greater economic justification and consumer impact analysis before the Department of Energy can finalize new or amended appliance efficiency standards, to prevent regulations that increase upfront costs, reduce product availability, or limit consumer choice without delivering proportional energy savings. The bill also provides a mechanism for amending or repealing previously implemented efficiency standards that are overly costly or technically infeasible. Finally, the bill changes the standard of compliance for efficiency standards for HVAC applications from date of compliance to date of manufacture. Met with officials from the Department of Energy to discuss the re-establishment of Home Energy Rebate Programs signed into law under the Inflation Reduction Act. Specific topics of discussion included fuel and energy choice as well as quality HVAC system installation and verification methods.

In a recent publication, the Education Commission of the States analyzed the "State of the State" addresses of 44 governors to find out what issues they care about the most. The group found that 34 governors highlighted workforce development and career and technical education (CTE) as top priorities. Many also proposed investment in job training programs using federal stimulus funds and also promoted increased grant funding to expand CTE programs. This report is encouraging as it shows America's leaders realize the importance of a skilled workforce and understand that further investment in career and technical education is a necessity. Earlier this year, President Biden approved a $45 million increase in funding for Perkins CTE Grants. This was one of ACCA's legislative priorities for the 117th Congress and marks the 6th consecutive year of funding increases for Perkins Grants. You can do your part to support the HVACR workforce by participating in ACCA's action alert on H.R. 3365 (the Student Debt Alternative and CTE Awareness Act) and H.R. 3366 (the Supporting Small Business and Career and Technical Education Act). These bills, introduced by Congressman Roger Williams (TX-25), would make common-sense changes that support small businesses and promote skilled trades.

H.R. 7671 Airborne Act - Congressman Don Beyer (D-VA) introduced the Airborne Act, which incentivizes non-residential building owners to conduct indoor air quality assessments (IAQ) and upgrade their ventilation and air filtration systems. Specifically, the Airborne Act would: Incentivize commercial building owners to conduct IAQ assessments of their properties by providing them with a $1 per square foot tax credit, not to exceed the cost of conducting the assessment. Incentivize commercial building owners to upgrade their HVAC/air filter systems to reach the American Society of Heating, Refrigerating, and Air-Conditioning Engineers (ASHRAE) Standard 62.1-2019 and a Minimum Efficiency Reporting Value (MERV) rating of 13 or better for their properties. This standard mirrors ASHRAEs Epidemic Task Force Recommendations from October 2021 to reduce the spread of respiratory diseases like COVID-19. The tax credit for upgrades is equal to $5 per square foot of property affected for air filters, and $50 per square foot for HVAC systems and is limited to 50% of the total project cost. Create a Department of Energy & Environmental Protection Agency voluntary certification program for property owners to certify that their properties are in compliance with the IAQ standards outlined above. Eligible recipients also include non-profits and for certain public properties, the credit is transferable to the appropriate private entity carrying out the upgrade.

Death Tax Repeal Act; S.617 and H.R. 1712 As you might know, the death tax, also known as the estate tax, entitles the federal government to 40 percent of estates valued at over $11 million. It is among the most confiscatory taxes in the country. Moreover, it applies to the market value of assets including vehicles, furniture, real estate, tools, equipment, and much, much more. Appraisers have even been known to include client lists as an asset contributing towards the $11 million threshold. The Death Tax Repeal Act-S. 617 and H.R. 1712 introduced by Senator Thune (R-SD), and Representatives Smith (R-MO) and Bishop (D-GA) respectively, is bipartisan legislation that would eliminate this unfair confiscatory tax that poses undue hardship on families across the country who own small businesses-including contractors. Please take a moment to participate in our action alert and let your representatives in Congress know why they need to support this important bill. The 25C credit is currently set to expire at the end of 2021. It was last renewed in December 2020 with bipartisan support. HOPE4HOMES Act of 2021; H.R. 3456 and S. 1768 ACCA is urging members of Congress to support H.R.3456 and S.1768, the HOPE4HOMES Act of 2021. The first part, HOPE (Home Online Performance-Based Energy-Efficiency) Training, will provide $500 million to contractor companies to enroll their employees online skill and training improvement courses. This is paired with the $6 billion HOMES (Home Owner Managing Energy Savings) Rebate Program that will provide incentives for homeowners to invest in energy efficiency improvements. Please take a moment to participate in our action alert and let your representatives in Congress know why they need to support this important bill. Section 199A, Main Street Tax Certainty Act; H.R. 1381 and S. 1381 Take action today to support the Main Street Certainty Act of 2021 (H.R. 1381 and S. 480), which would make the Section 199A deduction for small businesses permanent. Section 199A allows small businesses, also referred to as S-corporations or pass-through entities, to deduct 20 percent of their qualified business income (QBI). The Section 199A deduction was included in the 2017 Tax Cuts and Jobs Act to create greater tax parity between small businesses and larger corporations. In other words, its purpose is to level the playing field. It is currently set to expire at the end of 2025. Please take a moment to let your representatives in Congress know why they should support the Main Street Tax Certainty Act of 2021 (H.R. 1381 and S. 480) and make this important provision for small businesses permanent. 25C Permanence, Incentivize Residential Energy Efficiency Act; H.R. 3324 On May 18, 2021 Representative Roger Williams (R-TX) introduced H.R. 3324, the Incentivize Residential Energy Efficiency Act, which would make the Section 25C tax credit permanent. Section 25C offers homeowners a federal tax credit of 10 percent, up to $500, against the cost of energy efficient equipment-including HVAC systems. The 25C credit is currently set to expire at the end of 2021. It was last renewed in December 2020 with bipartisan support. Please take action today and urge your representatives in Congress to support this important legislation that will ensure greater certainty for the homeowners who utilize the 25C credit while also driving business for HVAC contractors and ACCA members across the country.

Jumpstart Our Businesses by Supporting Students (JOBS) Act; S. 864 and H.R. 2037 This bipartisan, bicameral legislation increases the flexibility of Pell Grants by extending eligibility to short-term job training programs which are in high demand. As you likely know, the skilled trades face a growing labor gap. The HVACR industry is no exception. It is estimated that 115,000 positions will need to be filled in our industry alone over the next 5 years. The short-term credentials highlighted in this bill can dramatically increase earning potential and help stem this labor gap, while also offering a significantly lower barrier to entry than a 4-year degree. HOPE4HOMES Act of 2021; H.R. 3456 and S. 1768 ACCA is urging members of Congress to support H.R.3456 and S.1768, the HOPE4HOMES Act of 2021. HOPE4HOMES has two components that will work together to help boost the HVACR industry. Participate in our action alert today and let your representatives in Congress know why they should support the HOPE4HOMES Act of 2021.

Paycheck Protection Program Small Business Forgiveness Act; H.R. 7777 and S. 4117 Take action for PPP loan forgiveness today by letting your representatives in Congress know that you support H.R. 7777 and S. 4117, the Paycheck Protection Program Small Business Forgiveness Act. If enacted, this bipartisan legislation would forgive all PPP loans of less than $150,000 upon the borrowers completion of a simple, one-page forgiveness document. Protecting the Right to Organize (PRO) Act; H.R. 842 Last month the Protecting the Right to Organize (PRO) Act, HR 842 was introduced in the House of Representatives. This bill seeks to radically rewrite our nations labor laws in favor of unions and at the expense of workers and employers. There are several troubling provisions in the law, but some of the most concerning include the following: Gives unions the power to demand employers not do business with other non-union companies Gives unions the sole determination over the manner elections are conducted-effectively eliminating secret balloting Eliminates workers rights to remove unions that have failed to adequately represent their interests Limits the ability of businesses and individuals to utilize independent contractors Bans all state right-to-work laws Eliminates the right of employers to withdraw recognition from a union, even upon evidence that all employees want the union out Mandates civil fines up to $50,000 for any unfair labor practice (double for repeat offenders), and $10,000 daily fines for non-compliance with any National Labor Relations Board order This legislation will kill jobs, strain supply chains, and significantly reduce opportunities for entrepreneurs and small businesses, and harm contractors across the country.

Congress is currently considering increasing in taxes in a number of ways for small and independently owned businesses. Some of the proposed policies include the following: raising the tax rate on pass-through corporations, capping the Section 199A deduction, increasing the capital gains tax, and imposing a double tax on estate transfers after death. Obviously, these policies would increase operating expenses as contractors are already contending with issues like inflation as well as supply and labor shortages. Congress is also considering a bank account reporting requirement that would require financial institutions to send information to the IRS on accounts with over $10,000 in gross inflows/outflows. This policy would affect the majority of taxpayers and would also carry massive privacy and security implications. It would also increase tax preparation costs and create operational challenges for financial institutions
Discussed the possibility of amending the American Innovation and Manufacturing (AIM) Act to include federal preemption of state and local laws and regulations governing the use, management, and phasedown of hydrofluorocarbon (HFC) refrigerants. Advocated for a consistent national regulatory framework to prevent conflicting state and federal requirements, reduce compliance burdens on HVACR contractors and manufacturers, and promote regulatory certainty throughout the transition to lower-global-warming-potential refrigerants.

Advocated for the restoration of energy efficiency tax incentives, including the 25C Energy Efficient Home Improvement Credit, 45L Tax Credit for Builders of Energy Efficient Homes, and 179D commercial energy efficiency deduction. In addition, we advocated for the introduction of a bill that would provide a tax incentive for workforce training in the skilled trades. This bill has not yet been introduced. Advocated for the WAGES Act - (H.R. 8624 and S. 4463) would create a refundable payroll tax credit to help employers offset the cost of hiring and training apprentices. Met with Congressman Moran's (R-TX) office to discuss.
Advocated generally for continued and increased funding for Perkins Career and Technical Education Grants. Advocated for the reauthorization of the Workforce Innovation and Opportunity Act, including expanded access and funding for On the Job Training Contracts. Advocated specifically for H.R.4049 and S.3846, the Employer-Directed Skills Act. This bill would establish employer-directed skills accounts under the Workforce Innovation and Opportunity Act. The new program would allow employers to select their trainees and type of training they receive, with training subject to local workforce board approval. Upon completion, employers would commit to hiring trainees. Employers also receive reimbursement for training costs, up to 50 percent of total costs.

Reducing burdensome regulations on small businesses has been a priority for ACCA. In recent years we have succeeded in stopping several anti-business regulations, including the Confined Space Rule and the Obama Administrations Overtime Rule. The Confined Space Rule would have required contractors to have an additional technician onsite if they were operating in an OSHA-defined confined space, which included attics and crawl spaces. The Overtime Rule would have required employers to pay overtime to most salaried workers who earn less than $47,476 annually, a sharp increase from the current annual salary limit of $23,660. SOLUTION: ACCA opposes burdensome government regulations that unnecessarily increase the cost of doing business. SOLUTION: ACCA believes that regulations should be based on industry-endorsed scientific research and standards.
If you haven't heard, the EPA is moving to ban disposable cylinders under the AIM Act. Late last year ACCA partnered with fellow HVACR industry associations Heating, Air-conditioning and Refrigeration Distributors International (HARDI) and Plumbing-Heating-Cooling Contractors Association (PHCC) in filing a petition to overturn the EPA's ban. That litigation is moving forward. Final written arguments are due on July 22, and we anticipate oral arguments taking place sometime in the fall.

179D Energy Efficiency tax deduction. 45L tax credit. ACCA President & CEO Barton James sent a letter to leaders in Congress urging them to re-open the U.S. Capitol complex to the public. Before the pandemic, the Capitol campus--which includes the U.S. Capitol, House and Senate office buildings, and over 270 acres of grounds--was a lively, vibrant environment, where Americans from across the country and all walks of life could engage with members of Congress and their staff on the issues affecting them. For the past two years or so, however, meetings have only been taken on a 'by appointment' basis, and as a result Capitol Hill has been noticeably unoccupied for much of that time. In his letter, Bart drove home the point that Congress should re-open to the public, stating: "The country is reopening. Businesses are moving back to working in person, students have returned to the classroom, venues are hosting concerts and sporting events, the hospitality industry working to re-establish itself as a pillar of the economy, and Americas HVAC-R contractors are performing work essential to our economy as frontline workers as they have done throughout the pandemic. We believe that Congress, too, should re-open and put this chapter of history behind us. It will serve as a sign of strength to America: that we are moving on from two very difficult years and that we are ready to take on challenges of the future together."
ACCA commented on OSHA's proposed heat stress rule which aims to "mitigate the effects of heat stress and heat related illness" through a number of policies including mandated breaks in compliant, sheltered or shaded areas as well as priority enforcement days when the heat index exceeds 80 degrees Fahrenheit. In its comment, ACCA stated that for some contractors, especially those working on remote jobsites that are difficult to get to, it could be more difficult for a contractor to find a compliant place to rest than it would be for them to simply take a break where they are. Further, it was our opinion that an 80 degree threshold for enforcement is entirely arbitrary, especially since there are many parts of the country (especially in the south and southwest) where the average temperature is above 80 degrees for much of the year. Finally, we informed OSHA that contractors are no strangers to working in the heat, and most HVAC-R contracting companies have detailed plans in place for workers on how to deal with working the heat including providing cooling towels and pads, ready access to water and electrolytes, and guidance on when to rest or take breaks among other policies. Since heat stress can easily take workers off the job, contractors have everything to lose and nothing to gain when it comes to dealing with work in the heat. A one-size-fits all approach from OSHA does not take into account the unique circumstances of individual workers and their health histories or previous acclimation to working in the heat. Nor does it take into account the differences between various industries and the nature of work being performed or understanding a given company might have when it comes to dealing with heat stress and related illnesses.
The federal government has numerous programs to help people find affordable housing. The federal government also funds programs to help low-income families with their energy bills. The Low Income Energy Assistance Program (LIHEAP) assists households with low incomes, particularly those with the lowest incomes that pay a high proportion of household income for home energy, primarily in meeting their immediate home energy needs. This program can be used to provide home cooling, weatherization, and/or energy-related low-cost home repairs or replacements. The Residential Energy Assistance Challenge Program (REACH) allows the Department of Health and Human Services to award supplemental LIHEAP funding for current grantees to receive competitive grants to implement innovative plans to help LIHEAP eligible households reduce their home energy vulnerability. If these housing and HVAC programs do not follow quality installation industry standards, then taxpayer money is being wasted on homes and HVAC systems that consume more energy than they are supposed to. SOLUTION: ACCA believes federally funded/financed housing programs should have HVAC systems installed according to nationally recognized quality installation standards. SOLUTION: ACCA believes that funding programs to help low income families install HVAC systems or improve their homes efficiency should follow the HVAC industrys installation/home evaluation & performance standards.

HOPE4HOMES has two components that will work together to help boost the HVACR industry. The first part, HOPE (Home Online Performance-Based Energy-Efficiency) Training, will provide $500 million to contractor companies to enroll their employees online skill and training improvement courses.
