Support S.J. Res 49 and H.J. Res. 98 resolutions to overturn Department of Labor Joint Employer Rule. Support S.J. Res 63 and H.J. Res. 116 resolutions to overturn Department of Labor Independent Contractor Rule. Support S. 1201/H.R. 2700, the Employee Rights Act, which would modernize our nations labor policies to match the needs of the 21st century worker and workforce by promoting growth and innovation, ensuring that our laws protect workers rather than union bosses, and allowing Americans to take home more of the money they earn. Support S. 991, the National Labor Relations Board Reform Act, which would end the partisanship by the NLRB by increasing the number of Board members from five to six evenly split between republicans and democrats; imposing new term limits for Board members; require four Board members to approve all decisions; restrain the NLRBs General Counsel and encourage quick resolution of cases before the Board. Support H.R. 1163/S. 1587, the Protecting Taxpayers and Victims of Unemployment Fraud Act, which would address fraud and overpayments of pandemic unemployment insurance benefits, including by providing incentives for states to investigate and recover overpayments of these benefits. Oppose renomination of Lauren McFerran to the National Labor Relations Board.

In opposition of H.J.Res.98 - Providing for congressional disapproval under chapter 8 of title 5, United States Code, of the rule submitted by the National Labor Relations Board relating to "Standard for Determining Joint Employer Status". This joint resolution nullifies the final rule issued by the National Labor Relations Board titled Standard for Determining Joint Employer Status and published on October, 27, 2023. The rule establishes a new joint employer standard for determining whether two employers simultaneously employ a particular employee or employees. Under the rule, an entity may be considered a joint employer of another employer's employees if the two share or codetermine the employees' essential terms and conditions of employment. The rule is currently scheduled to take effect on February 26, 2024. Issue: Project Labor Agreements (PLA). Educate staff and advocate for the use of PLAs. PLAs are pre-hire collective bargaining agreements negotiated between construction unions and construction contractors that establish the terms and conditions of employment for construction projects. PLAs are an effective tool to 1) ensure timely completion of projects at or under budget, 2) provide employers with a reliable source of highly skilled workers, 3) increase diversity and support equitable workforce development and 4) improve worker health and safety on the job. Expanding the definition of joint employer - On October 26, 2023, the National Labor Relations Board (NLRB) announced its final joint employer rule. The rule states that two or more entities may be considered joint employers of a group of employees if each entity has an employment relationship with the employees, and if the entities share or co-determine one or more of the employees essential terms and conditions of employment. The effective date of the new rule is February 26, 2024. The new standard will only be applied to cases filed after the effective date. that it would delay the effective date of the joint employer rule to February 26, 2024, in order to facilitate resolution of legal challenges with respect to the rule. The NLRB also clarified that the new standard will only be applied to cases filed after the rule becomes effective. NAPEO is opposed to this rule and supports legislation (H.J. Res. 98) which repeals the joint employer standard. E-Delivery - Each year, employers and health plans send more than a billion sheets of paper to Americas families regarding their health care benefits. Despite a strong preference for e-delivery health plan communications, federal law prohibits employers from defaulting to safe and secure electronic communications. Aligned with an overwhelming employee preference for e-delivery, recent federal rulemaking allowed for e-delivery in employee retirement plans. Extending greater flexibility for e-delivery in health benefit plans is a commonsense, straightforward regulatory action that would benefit the backbone of the economy - American workers, employers, and labor organizations - all while reducing the climate and environmental impacts of mandatory paper health care mailings.
