Infrastructure Investment and Jobs Act
Client: INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS · Firm: INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS
The International Brotherhood of Electrical Workers lobbied to support robust funding for high-speed rail programs. The U.S. is significantly behind global competitors in the development of high-speed rail. With targeted investment in this mode of transportation, the U.S. can dramatically reduce emissions from the largest emitting sector of greenhouse gases, transportation. However, these investments must also be paired with labor standards that cover the traditional workforce; The Railway Labor Act, the Railroad Retirement Act, and the Railroad Unemployment Insurance Act. Any federal program that invests in passenger rail transportation that does not include the federal statute for this coverage must be rectified. H.R. 3684 Infrastructure Investment and Jobs Act and H.R. 5376 the Build Back Better Act. The International Brotherhood of Electrical Workers (IBEW) lobbied to support a recalibration of the regulatory framework covering Class I Railroad Carriers. The U.S. Class I Railroads have become an industry that enjoys the benefits of high concentration, with little regulatory oversight. As a result, all Class I freight Carriers have made changes to their operating models that have led to a significant decrease in the workforce at the expense of safety within the industry and service to shippers. Therefore, the IBEW supports re-examining the regulatory framework to ensure that freight railroad carriers fulfill their statutory duty under the common carrier obligation.

If the IBEW and the Class I freight Carriers fail to reach an agreement, historically, Congress has stepped in to prevent a work stoppage. The IBEW has supported and continues to support the historical route for rail labor contract negotiations. Specific legislation includes H.R. 5376, the Build Back Better Act, or any tax package comprising the Build Back Better Act provisions. The International Brotherhood of Electrical Workers lobbied to support the continuation of the Railway Labor Act process. During national contract negotiations, the IBEW has negotiated in good faith for over two and a half years with all Class I freight carriers. The National Mediation Board has released the IBEW from mediation, and a Presidential Emergency Board has been created to issue recommendations for a settlement. If the IBEW and the Class I freight Carriers fail to reach an agreement, historically, Congress has stepped in to prevent a work stoppage. The IBEW has supported and continues to support the historical route for Rail Labor contract negotiations. The International Brotherhood of Electrical Workers (IBEW) lobbied to support a recalibration of the regulatory framework covering Class I Railroad Carriers. The U.S. Class I Railroads have become an industry that enjoys the benefits of high concentration with little regulatory oversight.

The International Brotherhood of Electrical Workers (IBEW) lobbied a against an amendment that was included in the Moving Forward Act (H.R. 2) that would prohibit DOT funds for purchasing rolling stock from the China Railway Rolling Stock Corporation (CRRC) and Build Your Dreams (BYD) under the FTA title of the Moving Forward Act. The IBEW supports the multi-year reauthorization of federal surface transportation programs, including the federal highway trust fund and federal programs supporting transit systems, and the inclusion of policies that will create well-paying, family-sustaining jobs while lowering carbon emissions in the transportation sector. Many of these policy objectives were includes in the Moving Forward Act (H.R. 2), which passed the U.S. House of Representatives in July 2020.
The IBEW lobbied for the consistent funding of two Virginia class submarines per year. This year the presidential budget outlined a decrease in the Virginia class submarine budget reducing the funds to one. The William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (H.R. 6395) and the Defense Appropriations Act, 2021 (H.R. 7617) would authorize and appropriate the amount needed for the construction of the second Virginia class submarine. The National Defense Authorization Act for Fiscal Year 2021 (S. 4049) only authorizes enough to procure materials for the submarine and stops short of fully funding the project. The IBEW represents thousands of members who work under collective bargaining agreements with commercial shipping companies, which include Electric Boat in New London, Connecticut and Ingalls Shipbuilding in Pascagoula, Mississippi; securing full funding of the Virginia class submarine would ensure stability in the industry.

The International Brotherhood of Electrical Workers (IBEW) lobbied in support of a comprehensive direct investment in the United States transportation sector. This approach must be prioritized to meet the infrastructure needs of the United States, especially following the economic impact of the novel Coronavirus. The inclusion of labor protections such as the Davis-Bacon Act and Buy America is imperative to the creation of jobs and stability in the American economy. The International Brotherhood of Electrical Workers (IBEW) lobbied in support of provisions outlined in S. 3884: Essential Transportation Employee Safety Act of 2020 that would require transportation companies to implement mandatory cleaning and disinfection of equipment and facilities within the workplace. S. 3884 would additionally require employers to issue personal protective equipment to workers that follow CDC recommendations in order to adequately protect against the COVID-19 virus and priority testing for transportation employees with the hightest risk of infection.
The International Brotherhood of Electrical Workers (IBEW) lobbied against proposed changes to the Paycheck Protection Program, which would eliminate the requirement that loan recipients use as least 75 percent of PPP funds towards payroll expenses. The International Brotherhood of Electrical Workers (IBEW) lobbied in support of the rehabilitation for Multiemployer Pensions provisions to be included in pandemic response legislation; text similar to Rehabilitation for Multiemployer Pensions Act (H.R. 397) and the Butch Lewis Act (S. 2254) would provide long-term, low-interest loans to distressed multiemployer defined pension plans. The intended effect of this legislation is to protect the defined pensions of over one million retirees and active workers in the United States and maintaining the long-term solvency of the Pension Benefit Guaranty Corporation (PBGC). The IBEW is the sponsor of the second-largest multiemployer defined benefit pension plan in the United States, the National Electrical Benefit Fund. The International Brotherhood of Electrical Workers (IBEW) lobbied against the inclusion of the Giving Retirement Options to Workers (GROW) Act in COVID-19 response legislation. The GROW Act would allow for the creation of new composite pension plans that would weaken the multiemployer pension system. Composite plans would allow for employers to withdraw from the pension system without playing liability, result in cuts to multi-employer pension benefits, and are exempt from paying Pension Benefit Guaranty Corporation (PBGC) premiums. The GROW Act was included in H.R.6800 - The Heroes Act.
