Rehabilitation for Multiemployer Pensions Act of 2019 This bill establishes the Pension Rehabilitation Administration within the Department of the Treasury and a related trust fund to make loans to certain multiemployer defined benefit pension plans. To receive a loan, a plan must be (1) in critical and declining status, including any plan with respect to which a suspension of benefits has been approved; (2) in critical status, have a modified funded percentage of less than 40%, and have a ratio of active to inactive participants which is less than two to five; or (3) insolvent, if the plan became insolvent after December 16, 2014, and has not been terminated. Treasury must transfer amounts, which may include proceeds from bonds and other obligations, from the general fund to the trust fund established by this bill as necessary to fund the program. The Pension Rehabilitation Administration may use the funds, without a further appropriation, to make loans, pay principal and interest on obligations, or for administrative and operating expenses. The bill allows the sponsor of a multiemployer pension plan that is applying for a loan under this bill to also apply to the Pension Benefit Guaranty Corporation (PBGC) for financial assistance if, after receiving the loan, the plan will still become (or remain) insolvent within the 30-year period beginning on the date of the loan. The bill also appropriates to the PBGC the funds that are necessary to provide the financial assistance required by this bill. The bill modifies the requirements for the distribution of remaining pension benefits from certain defined contribution plans to a designated beneficiary upon death of an employee. The bill increases penalties for failure to file a tax return, and certain retirement plan returns.

HR 397 - Rehabilitation for Multiemployer Pensions Act - Otherwise known as the Butch-Lewis Act, this serves as the Democrats solution to the Multiemployer Pension Solvency Crisis by creating a new administration within the Treasury Department to issue loans to plans with (a) critical and declining, (b) critical, or (c) insolvent status. While generally supporting an immediate resolution the crisis as well as moving debate to the Senate, NACD is in opposition to bills that do not address underlying structural issues impacting Multiemployer pensions. HR 4069 - Modern Worker Empowerment Act - H.R. 4069 would bring the Fair Labor Standards Act (FLSA) into the 21st century by updating the definition of employee, conforming the definition of employee with other New Deal era statutes that already apply a common-law definition for the term, and reconciling the FLSA with more recent U.S. Supreme Court decisions. HR2474/S1306 - PRO Act or Protecting the Right to Organize Act of 2019 - The bill, among several different provisions, would (a) force companies to turn over personally identifying information such as addresses, contact information, and shift information on employees to unions, (b) shorten the amount of time businesses would have to prepare for union certifying elections (c) modify the tests for independent-contractor and joint-employer to definitions not consistent with current employment trends, and make many other changes to labor and employment law that would be better debated individually. NACD is in opposition to this bill. In the year-end ombinus/coronavirus response package, NACD lobbied for business relief measures to be included as part of the text including tariff eliminations or deferrals. Additionally, NACD supported loan forgiveness feature covering payroll expenses for paid sick and family medical leave time. In advance of an additional omnibus/coronavirus emergency relief package, NACD again lobbied for tariff relief and other business support measures. NACD offered support and advocated for inclusion of loan forgiveness for Paycheck Protection Program borrowers under $150,000. On June 30, 2020, Senator Kevin Kramer introduced S. 4117, the Paycheck Protection Program Small Business Forgiveness Act, a bill that would modify loan forgiveness under PPP by providing automatic forgiveness of PPP loans that are not more than $150,000 if the recipient submits a one-page form. NACD supports and advocated for the passage of S. 4117 or inclusion of its text in any coronavirus emergency relief package. Maintaining Standard Business Deductions - When Congress passed the CARES Act earlier this year, the Internal Revenue Service took the step of determining that companies that use Paycheck Protection Program (PPP) funds to cover normally deductible expenses would no longer be able to do so. NACD, like much of congress, opposes the IRS decision on the grounds that it largely weakens the impact of the aid. NACD supports measures such as HR6754 and S3612 that would restore these standard business deductions. Additionally, NACD advocated for the inclusion of the Senates infrastructure language in the ombinus-relief package. NACD lobbied against inclusion of HR 397, otherwise known as the Butch-Lewis Act, any future coronavirus emergency relief bill as the bill does not address the underlying structural issues of the multiemployer pension crisis.

The International Brotherhood of Electrical Workers (IBEW) lobbied in support of the rehabilitation for Multiemployer Pensions provisions to be included in pandemic response legislation; text similar to Rehabilitation for Multiemployer Pensions Act (H.R. 397) and the Butch Lewis Act (S. 2254) would provide long-term, low-interest loans to distressed multiemployer defined pension plans. The intended effect of this legislation is to protect the defined pensions of over one million retirees and active workers in the United States and maintaining the long-term solvency of the Pension Benefit Guaranty Corporation (PBGC). The IBEW is the sponsor of the second-largest multiemployer defined benefit pension plan in the United States, the National Electrical Benefit Fund. The International Brotherhood of Electrical Workers (IBEW) lobbied against the inclusion of the Giving Retirement Options to Workers (GROW) Act in COVID-19 response legislation. The GROW Act would allow for the creation of new composite pension plans that would weaken the multiemployer pension system. Composite plans would allow for employers to withdraw from the pension system without playing liability, result in cuts to multi-employer pension benefits, and are exempt from paying Pension Benefit Guaranty Corporation (PBGC) premiums. The GROW Act was included in H.R.6800 - The Heroes Act. The International Brotherhood of Electrical Workers (IBEW) lobbied in opposition to the Giving Retirement Options to Workers (GROW) Act. While the legislation was not introduced as an individual bill, it was included in the Health and Economic Recovery Omnibus Emergency Solutions Act (HEROES) Act (H.R. 6800). The GROW Act would amend the Employee Retirement Income Security Act (ERISA) and the Internal Revenue Code of 1986 to authorize a new composite multiemployer pension plan design.

Continued effort to include a repeal or revised formula for the Windfall Elimination Provision for non-covered retirees. Monitored H.R. 860, the Social Security 2100 Act." The bill would provide an across-the-board benefit increase equivalent to about 2 percent of the average Social Security benefit amd make other substantial changes. The bill, introduced by Rep. John Larson (D-CT) did not move in the session. The identical Senate bill is S. 269, introduced by Senator Richard Blumenthal (D-CT). It did not move either. Monitored S.521, the Social Security Fairness Act, was introduced by Senator Sherrod Brown (D-OH). The bill would amend title II of the Social Security Act to repeal the Government pension offset and windfall elimination provisions. H.R. 141, the companion bill, was introduced by Rep. Rodney Davis (R-IL) the Social Security Fairness Act of 2019 and it now has over 200 bipartisan cosponsors, including several members of the Ohio delegation. Rep. Richard Neal (D-MA), Chairman of the House Ways and Means Committee, introduced H.R. 397, the Rehabilitation for Multiemployer Pensions Act. It is important to distinguish private and public multiemployer pension plans. It amends the Internal Revenue Code of 1986 to create a Pension Rehabilitation Trust Fund and to establish a Pension Rehabilitation Administration within the Department of the Treasury to make loans to multiemployer defined benefit plans. Chairman Neal introduced H.R. 4540 in 2019 to address the Windfall Elimination Provision (WEP). Rep. Brady introduced his bill, H.R. 3934, at the end of July 2019 to address WEP. Monitored both bills and discussed the need for WEP reform with House and Senate Offices and Committee staff.
